NY Marine argues that an ethical screening to prevent a conflict of interest wasn’t implemented until after the insurer raised the issue with Travelers’ counsel. Consequently, even if Chipman hadn’t represented NY Marine in the suit at hand or possessed the insurer’s confidential information, Maynard Cooper’s failure to implement an ethical screening before undertaking Travelers’ representation does not excuse the firm from disqualification, according to NY Marine.
