A Florida appeals court has overturned a ruling that required a father to maintain a $1 million life insurance policy to safeguard future child support payments, finding that the lower court failed to determine whether he could actually afford the coverage.

A three-judge panel ruled Wednesday that the trial court improperly ordered Angelo Furno to obtain the policy and incorrectly directed that the child's mother, Laura A. Vaughn, be listed as its beneficiary in a dispute involving paternity and child support.

The decision sends the insurance question back to the circuit court, putting a potentially significant financial obligation under a new microscope.

Florida Law Requires Findings Before Insurance Is Ordered

Florida law allows courts to require a parent to purchase life insurance as security for child support obligations. But that authority comes with conditions.

Before imposing such a requirement, a court must make appropriate findings about whether the insurance is necessary. Those considerations include evidence showing how much the proposed coverage would cost and whether the parent responsible for payments has the financial ability to afford it.

The appellate panel concluded those findings were missing in Furno's case.

As a result, the court remanded the matter to the circuit court, instructing it to examine the availability and cost of the insurance and determine whether Furno has the means to pay for the policy.

Mother Was Also Improperly Named as Beneficiary

The appeals court also found a separate problem with the trial court's order: It named Vaughn as the beneficiary of the life insurance policy.

The panel pointed to previous cases holding that a child's mother generally does not have a protectable interest in such a policy beyond the amount needed to secure child support payments.

Under the appellate ruling, the child must be designated as the beneficiary if the legal requirements for special insurance protection are satisfied.

Relocation Decision Remains Intact

Although the appellate court reversed the life insurance requirement, it did not dismantle the rest of the lower court's ruling.

The panel affirmed the decision allowing Vaughn and the child to relocate out of state, along with the other portions of the trial court's order.

The ruling therefore represents a mixed outcome for both sides: The father gets another chance to challenge the insurance obligation, while the mother retains the relocation approval granted by the lower court.

Attorney Welcomes Victory Despite Insurance Reversal

Sandy T. Fox of Sandy T. Fox PA, who represented Vaughn in the lower court, said he was pleased that the appellate panel upheld the relocation decision and other matters raised during the appeal that were not addressed in the written opinion.

Fox acknowledged disappointment that the court rejected the requirement that Furno maintain life insurance but said he respected the panel's reasoning.

He expressed hope that the parties can now move forward in a productive manner.

Furno was not immediately available for comment Wednesday.

Three-Judge Panel Sends Case Back

The decision was issued by Chief Judge Jonathan D. Gerber and Judges Melanie G. May and Shannon K. Shaw.

Both sides represented themselves in the appellate proceedings.

The ruling now returns the insurance issue to the circuit court, where the cost and availability of coverage—and Furno's ability to shoulder the expense—will have to be examined before a new decision can be reached.
