Border Crisis

The family alleges that the policies indirectly led to the release of an undocumented immigrant, affiliated with the notorious MS-13 gang, who went on to rape and murder Kayla. The lawsuit targets both Homeland Security and Health and Human Services, seeking answers and aiming to prevent similar incidents in the future.

Nobles, testified in impeachment proceedings against Homeland Security Secretary Alejandro Mayorkas. 

Speaking before the House Homeland Security Committee she recounted the devastating news she received on July 27, 2022, three days after Kayla turned 20. The young woman, who was autistic, was found murdered in her room allegedly a victim of an MS-13 gang member.

The Salvadoran had illegally entered the country but was released by Border Patrol agents because he was only 17 and fell into the “unaccompanied minor” category.

DNA Match to MS-13 Gang Member

Months passed without a suspect in custody, but authorities eventually announced the arrest of an unnamed 17-year-old in connection with Hamilton's death. His DNA reportedly matches the DNA found at the murder scene.

The grieving mother described Kayla as a "kind-hearted, very loving child" who, due to her trusting nature, could not perceive danger.

The suspect faces charges of first-degree murder, rape, and robbery, currently being held without bail. This tragic incident adds to a series of recent reports from Immigration and Customs Enforcement (ICE) regarding crimes committed by illegal immigrants against American citizens.

Open Border Policies

DHS reported over 11,000 illegal immigrants have been removed to over 30 countries since May 12, 2023. The department has been actively conducting Public Service Announcements (PSAs) to highlight deportation flights for migrants.

But an average of 1,070 individuals are allowed into the US daily via the CBP One app for processing. Some of them are coming through the parole process for immigrants from Cuba, Haiti, Nicaragua, and Venezuela.

As the legal battle unfolds, it underscores the complexities of border policies and the tragic consequences that can result from the release of individuals with criminal affiliations into the US.
