Calif. Judge Warns Fluoride in Water Risks Lowering Children’s IQ – EPA Ordered to Act Now

[SAN FRANCISCO, Calif.] - On Tuesday, U.S. District Judge Edward M. Chen ruled in favor of several environmental groups, acknowledging that the current "optimal" fluoride levels set by the U.S. Environmental Protection Agency (EPA) poses an unreasonable risk of lowering children's IQ. This decision came after a rigorous two-week bench trial in San Francisco, which concluded in February.

Judge Chen didn't mandate a specific course of action for the EPA but emphasized that regulatory measures could range from requiring warning labels to an outright ban on adding fluoride to drinking water.

The Science Behind Fluoride Exposure

For decades, municipalities across the United States have added fluoride to public water supplies at levels around 0.7 milligrams per liter. This practice was allegedly aimed at improving dental health and preventing tooth decay. However, recent scientific studies suggest that even low levels of fluoride exposure can be neurotoxic, particularly to developing brains.

Environmental groups like Food & Water Watch, Fluoride Action Network, and Moms Against Fluoridation presented expert testimonies indicating a statistically significant association between fluoride exposure and reduced IQ in children, even at levels previously considered safe.

Judge Chen noted, "The trial evidence establishes that even if there is some uncertainty about the precise level at which fluoride becomes hazardous, under even the most conservative estimates, there's not enough of a margin between the accepted hazard level and actual human exposure to find that fluoride is safe."

The EPA's Position and What's Next

The EPA had argued that new regulations were unnecessary due to the lack of clarity on the exact hazardous levels of fluoride and the dose-response relationship at lower exposures. However, Judge Chen was not persuaded, stating that the agency had improperly ignored substantial evidence indicating cognitive risks to children.

While the EPA reviews the decision, environmental groups are calling for immediate action. Wenonah Hauter, Executive Director of Food & Water Watch, praised the ruling, saying, "This court looked at the science and acted accordingly. Now the EPA must respond by implementing new regulations that adequately protect all Americans—especially our most vulnerable infants and children—from this known health threat."

As someone who has closely followed environmental litigation, I find this development both compelling and necessary. It's a wake-up call for regulatory bodies to re-examine long-standing practices in light of new scientific evidence.

"This ruling isn't just about fluoride; it's about the responsibility we have to safeguard our children's future based on the best available science," Samuel Lopez.

Potential Impact on Public Health Policies

It's crucial to consider the term neurotoxic, which refers to substances that can interfere with the normal function of the nervous system. In this context, fluoride's potential neurotoxicity is a concern because it could affect brain development in children.

In response to the ruling, the EPA stated on Wednesday that it is currently reviewing the court's decision.

Representing the environmental groups are attorneys C. Andrew Waters and Michael Connett of Waters Kraus & Paul LLP, along with Christopher T. Nidel from Nidel & Nace PLLC.

The government is represented by Brandon N. Adkins and Paul A. Caintic of the U.S. Department of Justice's Environment and Natural Resources Division, as well as Emmet P. Ong from the U.S. Attorney's Office for the Northern District of California.

This is the case of Food & Water Watch Inc. et al. v. Environmental Protection Agency et al., case number 3:17-cv-02162, in the U.S. District Court for the Northern District of California.
