CinemaCloudWorks Sues Comscore Over Alleged Box Office Data Monopoly

Comscore Inc., a dominant force in media analytics, is facing a wide-ranging antitrust lawsuit in California federal court after allegedly weaponizing its control over U.S. theatrical box office data to eliminate a competing software platform developed by CinemaCloudWorks, also known as Atlas Distribution.

The suit, filed Monday in the U.S. District Court for the Central District of California, alleges Comscore engaged in a deliberate campaign of anticompetitive conduct designed to block access to essential box office data unless Atlas agreed to abandon its competing CinemaCloudWorks application. Atlas claims the media giant violated federal antitrust law, California’s Unfair Competition Law, committed false advertising, and interfered with its existing and prospective business relationships.

Comscore’s Market Power at Issue

According to the 45-page complaint, Comscore wields near-complete control over theatrical box office data in North America, tracking approximately 99% of movie screens across the U.S. and Canada. Its data stream includes input from top theater chains like AMC, Regal, and Cinemark, and it counts every major and mini-major studio, along with top independent distributors, among its clients.

Atlas, which gained notoriety in the early 2010s for releasing the Atlas Shrugged film trilogy, has licensed Comscore’s data since 2014 to use in its own reporting and planning tools. This includes its proprietary software platform CinemaCloudWorks, a direct competitor to Comscore’s Theatrical Distribution System.

Alleged Sabotage of a Competitor

The suit alleges that in 2020, Comscore began restricting Atlas’s access to its data after identifying CinemaCloudWorks as a competitive threat. Atlas claims it was still under a valid license agreement and had not violated any terms, yet Comscore selectively blocked access, undermining its ability to support clients.

In 2024, tensions escalated when Comscore proposed a new contract that more than doubled Atlas’s subscription rate—from $13,885 to $29,000 annually—allegedly on the basis that Atlas’s data usage had “substantially exceeded” expected limits. However, Atlas says it received no supporting evidence for that claim despite repeated requests.

Then, in April 2024, Comscore abruptly terminated Atlas’s access entirely, citing a pretextual violation involving a publicly displayed graphic on Atlas's website that had been visible since 2018, the suit states. The real motive, according to Atlas, was to force it to either cease use of CinemaCloudWorks or abandon its ability to offer clients comprehensive analytics.

Tying Arrangement and Client Poaching Alleged

According to the complaint, Comscore has since told customers that its data cannot be used with CinemaCloudWorks, creating a chilling effect that has directly harmed Atlas’s client relationships. This, the suit argues, constitutes an illegal tying arrangement, where Comscore conditions access to its data on the use of its proprietary software—an action Atlas claims is intended “to eliminate Atlas as a competitor.”

Atlas contends this has resulted in immediate and irreparable harm, including severe operational disruptions, financial strain, reputational damage, and the risk of breaching distribution service agreements for at least nine films in various stages of release.

Court Relief Sought

Atlas is seeking a preliminary injunction requiring Comscore to reinstate its access to box office data under the prior subscription rate of $12,000 annually while the lawsuit proceeds. It also seeks unspecified monetary damages, attorneys’ fees, prejudgment interest, and equitable relief to remedy what it calls a blatant abuse of Comscore’s market dominance.

In its most recent earnings report, Comscore disclosed first-quarter revenue of $85.7 million, underscoring the scale and reach of its operations in media measurement.

CinemaCloudWorks is represented by Jonathan G. Gabriel and David S. Mayes of Gabriel Law Group PC.
Counsel for Comscore had not yet appeared in court as of Monday, and neither party responded immediately to requests for comment.
