Diversity Immigrant Visa Program Paused After Brown University and MIT Shootings

The Diversity Immigrant visa program has come under renewed national scrutiny after authorities confirmed that the Portuguese suspect in the Brown University and MIT shootings entered the United States through the long-standing visa lottery system. 

Following the identification of the Brown University shooting suspect, Homeland Security Secretary Kristi Noem announced on X that she was pausing the Diversity Immigrant visa program, asserting that the alleged shooter “should have never been able to come to the U.S.”

The case has prompted sharp reactions from the Trump administration, reigniting debate over whether the Diversity Immigrant visa program enhances opportunity or poses risks to national security, and whether suspending such a visa pathway amounts to justified caution or collective punishment.

What Is the Diversity Immigrant Visa Program?

The Diversity Immigrant visa program, created by Congress in 1990, makes up to 50,000 green cards available annually through a lottery system. The goal is to provide lawful immigration opportunities to people from countries that have historically been underrepresented in U.S. immigration flows.

Each year, the federal government reviews immigration data from the previous five years and allocates Diversity Immigrant visas to regions and countries with lower admission rates. For many applicants with no U.S.-based family members or employers to sponsor them, winning the Diversity Immigrant visa lottery is often described as “winning big.”

According to the U.S. Department of State, nearly 21 million people applied during the most recent 37-day application period. Roughly 130,000 applicants—representing winners and their family members—were selected, underscoring how competitive the visa lottery truly is.

Applicants who win are not guaranteed entry. They must still complete extensive paperwork, attend interviews, and pass rigorous background and security vetting conducted by U.S. authorities.

Regional Distribution and Vetting Requirements

This year’s Diversity Immigrant visa allocations included approximately 35,000 slots for applicants from Africa, 15,000 for Asia, and about 8,500 for Europeans. Even after selection, applicants undergo criminal background checks, medical exams, and multiple layers of screening by agencies such as U.S. Citizenship and Immigration Services (USCIS) and the Department of Homeland Security.

Immigration experts emphasize that Diversity Immigrant visa recipients are vetted similarly to other lawful immigrants. As the American Immigration Council noted in a 2017 report, the U.S. immigration system heavily favors family-based or employer-sponsored visas, leaving few legal options for otherwise qualified individuals without such connections.


“People who do not have U.S.-based eligible family members or employers able to sponsor their visas have very few opportunities for permanent, legal immigration to the United States,” the organization wrote.

Trump Administration Pauses Diversity Immigrant Visa

The Trump administration program pause marks the latest step by the Trump administration to restrict legal immigration following violent incidents involving foreign nationals. Officials have repeatedly argued that vetting systems may be insufficient, even as immigration advocates push back against that claim.

USCIS Director Joseph Edlow has been outspoken in his opposition to the program. In a September interview, he said he would like to see the Diversity Immigrant visa “gone,” adding later to The Associated Press that he supports a merit-based immigration system designed to benefit the U.S. economy.

“I’ve never really seen at this point the efficacy and the utility to continue the diversity visa,” Edlow said, noting that Congress would ultimately decide its future.

Political and Legal Questions Surrounding the Suspension

It remains unclear whether the administration can fully suspend the Diversity Immigrant visa program without congressional approval. Legal experts say Congress, which created the program, would likely have authority over a permanent suspension.

Secretary of State Marco Rubio framed the pause as a review rather than a condemnation of immigrants.


“The reason why you suspend this program is not because you argue everybody who came in under that visa is a bad person,” Rubio said. “It’s because you want to determine whether there’s something in the vetting of that program that’s insufficient.”

Critics, however, argue that the move unfairly targets millions of lawful immigrants. Myal Greene, head of World Relief, called the pause “the latest instance of the administration leveraging an isolated evil action to advance its goal of dramatically reducing legal immigration.”

A Broader Crackdown on Immigration

The Diversity Immigrant visa pause follows a series of aggressive immigration actions. After a separate shooting involving an Afghan national in Washington, D.C., the administration suspended asylum decisions related to Afghan nationals and tightened restrictions on people from 19 “high-risk” countries.

The administration has also expanded a travel ban to include 20 additional countries and largely dismantled the refugee program, which once admitted tens of thousands of people annually.
