Cher Wins Procedural Victory As Conservatorship Fight Over Son Elijah Blue Allman Shifts To New Hampshire

Cher’s years-long legal battle over the finances of her son, Elijah Blue Allman, has entered a complicated new phase involving courts on opposite sides of the country, competing family members and a separate criminal prosecution in New Hampshire.

The latest development came September 1 in Los Angeles Superior Court, where Judge Jessica A. Uzcategui considered Cher’s renewed petition seeking a conservatorship over her 50-year-old son’s estate.

Allman did not appear either in person or remotely. His attorney, Steven Brumer, also failed to appear.

The absence did not result in Cher automatically receiving control of her son’s finances. Instead, Uzcategui said Allman was entitled to legal representation, indicated that counsel would be reappointed for him and continued the California proceeding until December 1.

The distinction is important. Reports describing the hearing as a “victory” for Cher refer primarily to the procedural outcome. The judge has not made a final determination that Allman should be placed under a California conservatorship, nor has Cher personally been appointed to control his estate.

In fact, Cher had asked the California court shortly before the hearing to essentially pause the case while another court determines what protections should be imposed in New Hampshire.

According to an August 28 filing, New Hampshire State Hospital initiated guardianship proceedings on July 7 concerning both Allman’s person and estate. Cher’s lawyers told the California court that the principal dispute in New Hampshire had shifted from whether some form of guardianship was needed to who should serve as guardian.

Allman’s half-brothers, Chaz Bono and Devon Allman, have been proposed for guardianship roles. His wife, Marieangela King-Allman, has challenged the family’s approach and argued that she should be considered instead.

King-Allman has also formally opposed Cher’s California conservatorship effort. She has argued that a conservator selected by Cher could undermine Elijah’s recovery and autonomy. Cher’s attorneys, meanwhile, have strongly disputed King-Allman’s suitability to serve as a fiduciary and have questioned her motivations. Those assertions remain competing allegations by the parties rather than judicial findings.

The litigation represents Cher’s second major attempt to obtain financial oversight of her son.

She originally sought a temporary conservatorship in December 2023 amid concerns about his substance use and ability to manage his finances. That proceeding was ultimately voluntarily dismissed in September 2024 after mediation and efforts toward reconciliation.

But Cher returned to court in April 2026 following a series of developments in New Hampshire.

Her new petition alleged that Allman’s mental health, substance dependency and financial condition had deteriorated substantially. Cher sought appointment of professional fiduciary Jason Rubin rather than asking that she personally control her son’s estate.

Judge Uzcategui denied the requested emergency temporary conservatorship on April 24. Allman was already confined in a psychiatric facility and lacked immediate access to the assets at issue, reducing the urgency for extraordinary temporary relief. The ruling did not permanently foreclose Cher from pursuing a conservatorship.

At the center of the financial dispute are distributions Allman receives through a trust established by his late father, musician Gregg Allman.

Cher has alleged in court filings that her son cannot responsibly manage those funds because of addiction and mental-health problems. Allman and those opposing Cher’s petition have disputed whether a California conservatorship is necessary, particularly while he remains subject to treatment and court supervision in New Hampshire.

The jurisdictional question has consequently become increasingly significant.

Cher’s lawyers maintain that California retains jurisdiction because Allman remained domiciled there despite being hospitalized and detained in New Hampshire. They argue his presence in New Hampshire resulted from travel followed by arrest and confinement rather than an intentional permanent relocation.

King-Allman has challenged that position, arguing that Elijah no longer maintains sufficient California ties.

For the moment, however, the California proceeding remains alive.

Cher’s attorneys have indicated that if New Hampshire establishes a permanent guardianship that adequately protects Allman and his estate, she may voluntarily dismiss the California conservatorship petition. If the New Hampshire arrangement proves temporary or Allman leaves the state without comparable safeguards, Cher intends to continue pursuing relief in California.

The legal situation became even more complicated this week.

New Hampshire authorities confirmed that Allman has now been indicted on a felony criminal-mischief charge arising from an alleged March break-in at a Windham residence. He has pleaded not guilty to charges connected with the incident, which also include burglary and breach of bail. Proceedings in that case had previously been paused while he remained hospitalized, and an arraignment on the felony criminal-mischief indictment is expected next month.

Allman separately faces charges stemming from a February incident at St. Paul’s School in Concord, including simple assault, criminal trespass, criminal threatening and disorderly conduct. A competency hearing in that matter is expected later this fall.

That means three related legal tracks are now moving around Allman at the same time: the California conservatorship proceeding, the New Hampshire guardianship matter and his New Hampshire criminal cases.

The next major date in the California litigation is December 1, 2026.

Unless circumstances change before then, the central question is no longer simply whether Cher can obtain oversight of her son’s finances. The courts must also determine which state should exercise that oversight, what form it should take and who—if anyone—should ultimately be entrusted with managing Allman’s affairs.
