Sean “Diddy” Combs is facing a new legal complication in his $100 million defamation lawsuit after attorneys from Sher Tremonte LLP asked a federal judge to allow them to withdraw from representing him.

The dispute is not over the underlying merits of Combs’ defamation allegations. Instead, it centers on money, communication and whether the attorney-client relationship has deteriorated to the point that the firm can no longer effectively represent him.

Michael Tremonte, Erica Wolff and Katie Renzler filed the withdrawal request in Manhattan federal court. According to the filing, Combs has not made a payment to the firm in more than six months and is allegedly in “substantial arrears” for attorney fees, costs and expenses.

The attorneys further allege that the financial dispute is only part of the problem.

Tremonte told the court there has been a “total breakdown in cooperation and communication” between Combs and the firm. The filing alleges Combs has not made himself available for timely and substantive direct communications concerning his cases for more than four months.

Combs strongly disputes the firm's version of events.

“I made the decision to switch lawyers because I won’t let anyone take advantage of me by overcharging me and running up bills that were never approved,” Combs said through spokesperson Juda Engelmayer.

Combs characterized the disagreement as “strictly a business matter” and said the allegations concerning unpaid fees are part of a broader dispute over charges he says he did not authorize.

That distinction could become important. The firm's motion presents the situation as nonpayment coupled with a breakdown in the attorney-client relationship, while Combs portrays it as a client exercising his right to replace attorneys following a billing dispute.

A federal judge ultimately must determine whether Sher Tremonte may formally withdraw.

The controversy arrives at an important stage in Combs’ defamation litigation.

Combs sued Courtney Burgess, attorney Ariel Mitchell and Nexstar Media Inc., the parent company of NewsNation, over statements connected to Burgess’ appearances and allegations concerning purported recordings involving Combs.

Combs alleges that the statements were false and caused substantial damage to his reputation. His lawsuit originally sought $50 million before an amended complaint increased the requested damages to $100 million. The defendants have contested the claims.

The lawsuit has already survived, at least in part, efforts to end it.

A federal judge denied Mitchell’s attempt to dismiss the claims against her. The court dismissed some claims involving Nexstar but allowed other portions of Combs’ case to continue. Burgess, meanwhile, has not responded to the lawsuit, according to recent reporting.

One surviving issue concerns an allegation aired on NewsNation involving drug-laced baby oil. That means the litigation remains active despite the dismissal of other portions of Combs’ complaint.

The timing of the attorney dispute could therefore matter substantially.
