Sometimes a business plan collides not with market forces, but with the fine print of state law — and that's exactly what happened to Tesla's latest insurance ambitions. Tesla's effort to launch a new personal auto insurance program in New York recently hit a regulatory wall, after state officials formally rejected the company's proposal before it ever got off the ground.

The Filing That Didn't Pass Muster

The New York Department of Financial Services rejected a filing from Tesla General Insurance Inc. that would have restricted eligibility exclusively to Tesla vehicles, identified specifically through vehicle identification numbers, or VINs. Regulators raised concerns under Section 2324 of New York Insurance Law before even getting to the actuarial substance of the filing, according to an analysis from S&P Global Market Intelligence — essentially stopping the proposal at the structural level before evaluating whether the pricing itself made sense.

Why Tesla Built Its Own Insurance Arm

According to Tim Zawacki, head of financial institutions research at S&P Global Market Intelligence, Tesla's insurance operation was never designed to compete broadly across the insurance market. "Its purpose is not to be a competitive source of insurance coverage for a broad segment of the market," Zawacki said. "It's to essentially eliminate a point of friction in the Tesla sales process" — framing the insurance business less as a standalone venture and more as a support system for Tesla's core car sales.

Building on Driving Data

Tesla launched its insurance business around a model incorporating driving data collected directly from its vehicles. Over time, the company has increasingly shifted its insurance business toward Tesla-affiliated insurers and away from outside carriers, a strategy Zawacki attributes partly to broader industry reluctance around electric vehicles. Some insurers, he explained, have been hesitant to write EV policies or have charged higher premiums due to elevated repair costs and loss severity tied to EV claims specifically.

A Rapidly Growing Insurance Business

Previous S&P research found that Tesla generated $1.37 billion in direct written premiums during 2025, marking a 40.7% jump from $970.8 million the year before. Tesla-affiliated insurers handled 75.9% of Tesla's insurance business directly in 2025, a sharp increase from just 32.6% in 2024 — evidence of a company rapidly internalizing an operation it once outsourced.

California Dominates, New York Sits Empty

California has remained Tesla's largest insurance market by a wide margin, representing nearly 70% of premium volume during 2025, with the state's premium volume climbing to $725 million, according to S&P. Tesla has also expanded insurance availability into additional states while simultaneously taking on more underwriting risk itself, even as those expanded operations reported roughly $182.7 million in underwriting losses during 2025, alongside an overall direct loss ratio of 100.4%.

Recent Numbers Paint a Similar Picture

More recent figures reinforce this geographic concentration. Tesla's insurance entities generated $644.2 million in direct written premiums during the first half of 2026 alone. California accounted for $477.8 million of that total, followed by Texas at $60.4 million, Nevada at $23.3 million, and Maryland at $15 million. New York, notably, produced no direct written premium during that same period — despite Tesla Insurance Co. holding an active license in the state, according to S&P.

Why New York's Objection Was Unusual

The New York filing centered specifically on eligibility requirements rather than pricing concerns. The proposed program would have restricted participation to Tesla vehicles through VIN-based eligibility, a structure S&P said regulators viewed as raising concerns under New York's anti-tie-in provisions — prompting them to address that structural issue before reviewing any other aspect of the filing.

What makes this rejection particularly notable is that New York has historically expressed support for telematics and usage-based insurance more broadly, creating a somewhat paradoxical situation where regulators objected specifically to the program's structure rather than its underlying technology. "Their efforts to establish a program in New York, for example, have been thwarted by state regulation, which does not permit a company to underwrite only one manufacturer's vehicles," Zawacki explained.

Regulators Support the Technology, Not the Structure

In guidance issued to insurers, the New York Department of Financial Services has said telematics can improve underwriting decisions, align premiums more closely with actual risk, and encourage safer driving behavior. The department has also actively encouraged insurers to submit telematics and usage-based insurance programs for review — signaling that New York's objection wasn't rooted in skepticism toward data-driven insurance itself.

What Usage-Based Insurance Typically Involves

According to the National Association of Insurance Commissioners, usage-based insurance programs can incorporate factors like mileage, acceleration, braking patterns and driving times when evaluating risk and setting premiums — the broader category of technology that Tesla's rejected program fell under, even if its specific structure ran into trouble.

Tesla's Safety Score Under the Microscope

The New York filing also involved Tesla's Safety Score model, which the company says evaluates driving behavior using vehicle-collected data to estimate the likelihood of a future collision. Tesla states the model draws on billions of miles of driving data gathered across its fleet. In states where Tesla's Real-Time Insurance product is available, the company says Safety Score can directly affect monthly premiums, relying entirely on vehicle-generated data rather than separate plug-in devices or additional hardware.

Regulators Deny Confidentiality Request

S&P reported that regulators denied Tesla's request for confidential treatment of documentation related to the Safety Score model — meaning at least some details of how the model functions may become more publicly accessible than Tesla had hoped.

While Tesla frequently emphasizes the sheer scale of its driving-data collection, Zawacki cautioned that the practical underwriting advantage of that data can vary significantly depending on individual state regulations. "It's not particularly meaningful," he said regarding California specifically, noting that restrictions there limit how telematics data can actually be used within the underwriting process.

Ongoing Scrutiny of Data-Driven Insurance

This review arrives as New York lawmakers and regulators continue examining telematics programs and data-driven insurance models more broadly. Recent proposals have focused on transparency requirements, consumer access to telematics information, and stronger oversight of the models insurers use to set pricing.

Tesla's Approach Remains an Outlier

Tesla isn't alone in incorporating vehicle data into insurance products — General Motors Insurance, for instance, uses connected-vehicle technology to help personalize rates, while also allowing customers to insure non-GM vehicles under the same policy. GM says its program leverages technology already built into connected vehicles rather than requiring additional devices, a notably different approach from Tesla's rejected New York proposal, which would have limited eligibility exclusively to Tesla vehicles.

Zawacki noted that Tesla's overall approach remains distinctly unusual among U.S. automakers, most of which have relied on partnerships and referral arrangements with established insurers rather than building out their own dedicated insurance operations. "There really aren't any parallels, I don't think, for what Tesla's structure is like in the U.S. market," he said.

A Growing Trend Across the Industry

The NAIC has identified connected-car technology as an increasingly significant component of usage-based insurance programs, as both insurers and automakers gain access to ever-larger volumes of driving and vehicle data.

For Tesla, this New York setback highlights a broader challenge facing its insurance ambitions — even as the company's data-driven model succeeds in states like California, expanding that same structure into markets with stricter anti-tie-in protections may require rethinking the very foundation the program was built on.
