LOS ANGELES – In a dramatic rebuke that is reverberating through the legal sector, two prominent law firms—K&L Gates LLP and Ellis George LLP—have been sanctioned a total of $31,100 after submitting a federal court brief riddled with fictitious legal citations produced by artificial intelligence. The debacle, described as a “collective debacle” by Special Master Michael Wilner, has set off renewed debate over the pitfalls of AI-assisted legal writing—and the ethical duty of lawyers to verify every word.

The trouble began in the Central District of California, where a routine discovery dispute in a civil case involving State Farm General Insurance Co. became anything but ordinary. Charged with reviewing supplemental briefing, former Magistrate Judge Wilner uncovered that at least nine out of 27 legal citations in plaintiff’s brief were “incorrect in some way.” Some citations referenced cases that do not exist; others included fabricated quotations attributed to real cases.

But how did such egregious errors slip through the cracks at powerhouse firms known for their meticulous approach?

Court records reveal that Trent Copeland, a well-regarded attorney with Ellis George, relied on “several AI tools” to draft an outline of the brief. He then forwarded this AI-assisted outline to K&L Gates, where—crucially—no one vetted the case citations before they were integrated into the final document.

Wilner’s order paints a picture of widespread breakdowns in professional responsibility. Not only did K&L Gates attorneys remain unaware that AI had been used, but “nor did they ask him,” the judge noted. When initial concerns were raised about two dubious citations, K&L Gates tried to excise the offending material and resubmit. Yet, even the revised filing contained “a half-dozen AI errors,” Wilner said.

“Approximately nine of the 27 legal citations in the 10-page brief were incorrect in some way. At least two of the authorities cited do not exist at all. Additionally, several quotations attributed to the cited judicial opinions were phony and did not accurately represent those materials. The lawyers’ declarations ultimately made clear that the source of this problem was the inappropriate use of, and reliance on, AI tools,” Wilner wrote in his ruling.

In a scathing 77-page ‘Order Imposing Non-Monetary Sanctions & Awarding Costs” issued May 6, Special Master Wilner noted that neither firm performed the necessary diligence to confirm the veracity of the legal authorities cited—an omission that fundamentally undermined the integrity of the brief.

To “rectify the collective debacle,” Wilner ordered the law firms to pay $26,100 to reimburse State Farm for alternative dispute resolution fees, plus an additional $5,000 for costs specifically resulting from the AI-related errors. The order also denied the plaintiffs’ requested discovery, making clear that the submission’s flaws had tainted their advocacy.

In the world of artificial intelligence, “hallucinations” are errors in which an AI tool invents information, such as case law, statutes, or quotations, that does not actually exist. While such glitches may seem like innocent machine mistakes, in legal practice, the consequences can be catastrophic—leading to sanctions, professional discipline, and damage to client interests.

The American Bar Association and courts across the country have urged lawyers to maintain “technical competence”and not blindly trust generative AI tools, especially for core functions like legal research and brief drafting.

This case is not an isolated incident. Over the past year, multiple attorneys nationwide have faced sanctions and reputational fallout for relying on generative AI tools that fabricated legal citations. The now-infamous Mata v. Avianca, Inc. case in the Southern District of New York, for example, saw lawyers penalized for submitting a brief citing “phantom” court opinions invented by ChatGPT.

The consensus is clear: AI can assist but never replace the judgment, scrutiny, and accountability of a licensed attorney.

The $31,100 penalty serves as a warning shot for law firms everywhere. As clients, courts, and the public demand greater transparency and technical skill, the legal sector must adapt—balancing innovation with rigorous review.

Wilner’s decision was not merely punitive; it was prescriptive. By imposing fee shifting, he ensured that the cost of AI negligence would be borne by those responsible, not by the innocent party.
