What This Record Verdict Really Means

Apple has just been handed what appears to be the largest patent jury verdict in U.S. history — more than $5.72 billion — over technology most iPhone and Apple Watch owners probably use without ever thinking about it.

A federal jury in San Diego found Friday that Apple infringed claims from two patents owned by Taction Technology Inc., U.S. Patent Nos. 10,659,885 and 10,820,117. Both involve technology for producing controlled vibrations that can be perceived through touch.

At the center of the case is Apple's Taptic Engine, the internal hardware that gives users physical feedback when they tap, click, receive alerts, or interact with certain features on iPhones and Apple Watches.

The number is extraordinary. The jury awarded Taction exactly $5,721,961,750. For perspective, one of the previous record-setting U.S. patent verdicts was the $2.54 billion award against Gilead Sciences in 2016 — a verdict that was later wiped out after the underlying patent claims were found invalid.

That history matters.

A multibillion-dollar jury verdict makes headlines, but it does not mean a check for $5.7 billion gets written Monday morning.

Apple has already said it will appeal. The company maintains that its Taptic Engine is fundamentally different from Taction's technology and argues that testing presented at trial supported its position. Apple said the verdict and damages were unsupported by the facts.

The case has already survived one major reversal.

Taction sued Apple in 2021. In 2023, U.S. District Judge Todd W. Robinson granted Apple summary judgment, effectively ending Taction's infringement case before trial. But in August 2025, the U.S. Court of Appeals for the Federal Circuit vacated that ruling, finding problems with the exclusion of portions of Taction's expert testimony and the interpretation of the patent claims. The case returned to San Diego — and eventually to the jury that delivered Friday's massive award.

There is another detail that could become increasingly important as the litigation continues: litigation financing.

Discovery showed that Taction received financing connected to Gronostaj Investments LLC and Kenosha Investments LP. Kenosha has been identified in other litigation as an indirect subsidiary of litigation-finance company Burford Capital. That means the ultimate economic proceeds of this case may not flow exclusively to Taction if the verdict survives.

The jury also found Apple's infringement was not willful. That matters because federal patent law permits courts, in appropriate cases, to increase damages by as much as three times. A finding of non-willfulness makes that kind of enhancement considerably harder to obtain.

And one more procedural point should not get lost beneath the $5.7 billion headline: reports following the verdict indicated that a formal final judgment had not yet been entered on the docket. Post-trial motions are expected, Apple can challenge the damages calculation and other portions of the verdict, and any appeal would return to the Federal Circuit — the same appellate court that revived Taction's case in 2025.

For Apple, Friday's verdict is historic.

But legally, it may be closer to the beginning of the next fight than the end of this one.
