Are the Parents of the Madison School Shooter Liable Under Wisconsin Law?

Natalie Rupnow, 15, tragically carried out a school shooting in Madison, Wisconsin. Federal and Wisconsin law prohibits anyone under 18 from possessing a firearm.

After her rampage, Rupnow used the handgun to take her own life, according to Madison Police Chief Shon Barnes. The possibility of criminal charges against her parents remains under investigation.

Madison School Shooter Had Two Guns

Two firearms were discovered at the scene of the shooting. Madison police confirmed that one handgun was used in the attack, while the second gun remained unused.

A Facebook photo posted in August by Rupnow’s father, Jeff Rupnow, showed his daughter at a shooting range. In the image, Natalie wore a black shirt with the name of the band KMFDM, whose lyrics were cited by perpetrators of the Columbine High School massacre in 1999.

Whether the Rupnow parents owned or possessed the firearm used in the shooting is unclear. Chief Barnes stated that police and the district attorney’s office will investigate potential negligence on the part of the parents.

Gun Ownership Issues

The U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives traced the origins of the firearms used in the incident. However, police have withheld further details about the weapons to avoid jeopardizing their investigation.

“Determining the weapon’s origin, who purchased it, and how it ended up in the hands of a 15-year-old girl will be critical to the case,” Chief Barnes said.

Madison’s mayor refrained from commenting on potential criminal charges against the parents. Investigators confirmed that the parents are cooperating with authorities and, as of now, there is no evidence that they committed a crime.

Wisconsin Law

Wisconsin law imposes restrictions on children’s access to firearms. Dane County Executive Melissa Agard criticized the state’s existing regulations, describing them as insufficient.

“Our laws in Wisconsin are far too lax when it comes to access to guns by children,” Agard stated. “We need comprehensive background checks, red flag laws, and adequate behavioral health support in our communities. People seeking help shouldn’t have to wait.”

State law prohibits the intentional sale, loan, or gifting of firearms to anyone under 18, except in specific cases such as target practice under adult supervision, military service, or hunting. Violating this law can lead to a prison sentence of up to three and a half years. If a minor uses the firearm to cause death, the penalty increases to six years in prison.

Holding Parents Accountable

Wisconsin’s child access firearm law further penalizes reckless storage of loaded firearms accessible to children under 14. Individuals can face up to nine months in prison if a child accesses the firearm without permission and causes harm or death to themselves or others.

Prosecutors nationwide have sought to hold parents accountable in similar school shooting cases. Recent examples include the 2021 Oxford High School shooting in Michigan and a September incident at a Winder, Georgia high school.

As investigations continue, Wisconsin authorities will determine whether Natalie Rupnow’s parents can be held responsible under state law for her access to firearms. This case underscores the ongoing debate over firearm safety, parental accountability, and stricter gun regulations in the United States.
