Case Intel — What You Should Know

  • Verified filing: Ashley Biden filed for divorce from Dr. Howard Krein in the Philadelphia Court of Common Pleas; the public docket lists Case No. D25088462 and attorney Charles J. Meyer for the plaintiff.  Court Docket
  • Why it matters legally: In Pennsylvania, the date of separation is pivotal for both support and property division; assets acquired after separation are generally excluded from the marital estate. Findlaw Pennsylvania General Assembly
  • Likely path forward: High-profile, high-net-worth divorces typically resolve by settlement before trial, and both Pennsylvania and Delaware law emphasize amicable resolution and equitable outcomes. Delaware Code Online

Ashley Biden, the daughter of former President Joe Biden and former First Lady Jill Biden, has formally filed to dissolve her 13-year marriage to Dr. Howard Krein, a Philadelphia otolaryngologist and plastic surgeon. The filing was made in the Philadelphia Court of Common Pleas, Family Division; a city docket query reflects Case No. D25088462 and identifies Charles J. Meyer, Esquire as attorney for the plaintiff. USA Herald first reported the filing; hours later, Biden shared an Instagram Story signaling a turn toward “new beginnings.”

On social media, Biden reposted the line: “New life, new beginnings means new boundaries. New ways of being that won’t look or sound like they did before,” pairing it with Lauryn Hill’s “Freedom Time.” She also shared a video set to Beyoncé’s “Freedom.” These posts were widely noted in coverage confirming the Philadelphia filing.

What’s next for the plaintiff at this stage

Procedurally, the near-term steps in a Philadelphia divorce are straightforward and often administrative:

  • Service and waiting period. After the complaint is filed and served, Pennsylvania permits a 90-day cooling-off period before a consent divorce can be finalized, provided both parties file Affidavits of Consent. If one party will not consent, a no-fault divorce may proceed after the parties have lived “separate and apart” for at least one yearPhiladelphia Courts
  • Support during the case.A dependent spouse may seek Spousal Support (even pre-filing), Alimony Pendente Lite (APL) during the litigation, and—post-decree—alimony if warranted by statutory factors. APL and spousal support end when the decree is entered; any ongoing obligation becomes alimony if ordered.  David Wenger, Attorney
  • Property disclosures and negotiation. The parties typically exchange financial information and attempt to resolve equitable distribution (property division) by agreement or through court-supervised settlement processes. Philadelphia’s own materials emphasize that “equitable” does not necessarily mean 50/50. Philadelphia Courts

Why the date of separation will be crucial

Pennsylvania’s Divorce Code makes the date of separation a legal hinge point:

  • It’s defined as the “cessation of cohabitation”—even if spouses remain under one roof. When a divorce complaint is filed and served, there’s a presumption that the parties were living separate and apart by that date (a presumption that can be rebutted). Findlaw
  • For property divisionproperty acquired after final separation is excluded from marital property (unless purchased with marital assets), while increases in value of certain premarital or gifted property during the marriage can be in play. This makes pinning down the separation date essential for valuing the estate. Pennsylvania General Assembly
  • For support, courts weigh the duration of the marriage and financial circumstances when deciding alimony; timing can also affect whether and how long interim support (spousal support/APL) is appropriate before the decree. Justia Law

High-net-worth, high-profile divorces often settle quickly

While every case is unique, most divorces do not go to trial. National family-law references routinely report that well over 90% of divorce matters resolve through negotiated settlements or mediation. Privacy, speed, and cost control are among the reasons affluent or prominent parties choose structured settlement tracks over public courtroom litigation. Delaware’s Divorce and Annulment Act even codifies a goal “to promote amicable settlement of disputes.”  Cacace Tusch Santagata Attorneys Delaware Code Online

Faith and law: Does a civil petition align with Catholic teaching?

The couple wed at St. Joseph on the Brandywine Roman Catholic Church in Greenville, Delaware, in a Catholic-Jewish ceremony. Catholic doctrine holds marriage to be indissoluble, but the Catechism allows that civil divorce can be tolerated when it is the only means to secure essential legal rights, protect children, or preserve inheritance—while the sacramental bond remains unless and until an ecclesiastical tribunal grants an annulment. Thus, a civil filing can coexist with Church teaching under specific conditions, though remarriage in the Church would generally require an annulment.  Vatican USCCB

Does “long-term marriage” change the rules? A California-vs-Pennsylvania-vs-Delaware snapshot

  • California labels marriages of 10+ years as “long-Term-Marriages” for spousal-support purposes, allowing courts to retain jurisdiction over support potentially indefinitely—a bright-line rule that often shapes negotiations.
  • Pennsylvaniauses equitable distribution and alimony factors without a fixed 10-year threshold; length of the marriage is an explicit factor, but there is no automatic long-marriage rule. Outcomes turn on the 23 Pa.C.S. factors and the case facts. Pennsylvania General Assembly
  • Delaware also considers the length of the marriage in dividing property and, for alimony duration, sets a notable benchmark: eligibility generally cannot exceed 50% of the marriage’s lengthexcept that marriages of 20 years or longer have no time limit on eligibility (still subject to all statutory factors). For a 13-year union like Biden–Krein, the 20-year threshold isn’t reached; if Delaware law applied, the outer eligibility window would be up to ~6.5 years—again subject to the court’s factor analysis. Justia Law

Because this petition is filed in PennsylvaniaPennsylvania law governs the divorce, support, and property division—though parties sometimes consider choice-of-law concerns for discrete issues (e.g., contract interpretation for a prenup). The core takeaway is that duration matters in all three jurisdictions, but California’s “10-year” effect is not mirrored in Pennsylvania and only partly reflected in Delaware via its 20-year alimony rule.

Background notes

Ashley Biden and Dr. Krein met in 2010 through her late brother, Beau Biden, and married in 2012. Krein has been affiliated with Thomas Jefferson University Hospitals in Philadelphia. Philadelphia divorce complaints are not public, limiting what’s known about specific claims or requested relief at this stage.
