Atlantic Coast Insurance Suspension Follows Growing Financial Concerns

The atlantic coast insurance suspension has added another layer of uncertainty for policyholders after Florida regulators moved against Atlantic Coast Life Insurance, just two weeks after South Carolina authorities began rehabilitation proceedings involving the insurer.

Florida Insurance Commissioner Michael Yaworsky signed an Immediate Final Order Wednesday, Sept. 30, suspending Atlantic Coast Life’s certificate of authority after determining the company was financially impaired and noting that South Carolina’s insurance department had already initiated rehabilitation proceedings.

The action places another state regulatory wall around a company whose financial condition has come under increasing scrutiny.

Florida Regulators Raise Alarm Over Insurer’s Finances

Atlantic Coast Life is headquartered in South Carolina but has been authorized to operate in Florida since 2006 as a life and health insurer. The company belongs to Advantage Capital Holdings, commonly known as A-Cap, which is led by CEO Kenneth King and is currently subject to a planned takeover by Oaktree Capital Management.

Regulators have raised concerns over Atlantic Coast Life and its reinsurance affiliate, Southern Atlantic Re, including their exposure to failed investment firm 777 Partners.

Officials have also alleged that the companies failed to disclose certain investments involving affiliated entities.

In Florida, Atlantic Coast has primarily built its business around annuities. As of August, the company held 6,001 annuity policies, along with 986 life insurance policies and 19 accident and health policies.

The insurer reported collecting nearly $13 million in premiums in Florida so far this year, according to the Florida Office of Insurance Regulation order.

But beneath those numbers, regulators found a much more troubling picture.

Surplus Figures Deteriorated Sharply

Florida regulators relied on Atlantic Coast’s own financial filings when examining whether the company maintained enough surplus to meet its obligations.

In September 2025, Atlantic Coast reported an $86 million surplus, apparently putting the insurer nearly $30 million above the statutory minimum.

Florida law, however, restricts how much an insurer can count toward surplus from investments in subsidiaries and affiliated companies.

Once those restrictions were applied, the insurer’s surplus was considered impaired by nearly $140 million, according to Yaworsky’s order.

The situation worsened by the second quarter of this year.

Atlantic Coast reported a surplus of $47 million, below the $55 million surplus required under Florida law. After regulators applied statutory limits to affiliated investments, the company’s impaired surplus expanded to roughly $170 million.

The numbers effectively turned what appeared to be a cushion into a financial sinkhole.

Atlantic Coast Ordered to Halt New Florida Business

The atlantic coast insurance suspension will remain in place until Florida regulators determine that the company is no longer impaired.

Under the order, Atlantic Coast must immediately stop soliciting new business and renewal business in Florida. The insurer must also notify its agents and brokers about the suspension.

The order does not, however, allow the company to simply walk away from existing customers.

Atlantic Coast must continue servicing all Florida policies that remain in force and must honor liabilities for covered losses and unearned premiums if those obligations continue to exist.

Yaworsky said Florida regulators acted after closely monitoring the insurer’s financial position.

“Atlantic Coast’s concerning financial condition” prompted the office to issue its Immediate Final Order and notify insurance agents to stop further transactions in the state, Yaworsky said in a statement provided to Insurance Journal.

He added that Florida has multiple tools available to monitor insurers’ financial health and said regulators would continue taking action when necessary.

South Carolina Rehabilitation Adds to Pressure

Florida’s concerns echo issues raised by South Carolina insurance officials in their rehabilitation proceedings.

The South Carolina petition alleges that Atlantic Coast and related respondents placed policyholder funds into investments regulators considered high-risk and inappropriate, allegedly violating state law and agreements with the Department of Insurance.

That proceeding came roughly two weeks before Florida imposed its suspension, creating a widening regulatory challenge for the insurer.

Atlantic Coast’s parent company, A-Cap, and King have previously rejected suggestions that the company’s past dealings with 777 Partners could prevent Atlantic Coast from meeting its commitments to policyholders.

The competing claims leave Atlantic Coast facing a critical financial and regulatory test: stabilize its balance sheet, satisfy regulators and demonstrate that it can continue meeting obligations to customers.

For now, Florida has drawn a firm line. New business is off the table, while existing policyholders remain within the company’s responsibilities as regulators continue examining its financial condition.

The atlantic coast insurance suspension therefore marks more than a temporary business restriction. It represents the latest consequence of financial concerns that have now crossed state lines, putting the insurer’s future under increasingly close regulatory watch.
