Barry Morphew Re-Arrested in Suzanne Morphew Homicide Case Three Years After Charges Dropped

Barry Morphew, the husband of Suzanne Morphew, has been re-arrested on a first-degree murder charge, reigniting a high-profile Colorado case more than four years after Suzanne’s mysterious disappearance on Mother’s Day 2020.

The arrest comes nearly one year after her skeletal remains were discovered and three years after initial murder charges against Barry were dropped.

A Renewed Murder Charge After Years of Mystery

Barry Morphew was arrested Friday in Arizona after a Colorado grand jury returned a fresh indictment. Authorities confirmed his bond has been set at $3 million cash-only. According to court documents and a statement from the district attorney’s office, Barry will be extradited to Colorado to face trial.

Suzanne Morphew, 49, vanished in May 2020 near Salida, Colorado. Her bike and helmet were discovered in suspicious locations — staged rather than crashed, authorities believed. For over three years, her whereabouts remained a mystery until her remains were discovered in a shallow grave in Moffat, about 40 miles from her home.

Drugs and Suspicion: What the Autopsy Revealed

In 2024, a long-awaited autopsy ruled Suzanne’s death a homicide by unspecified means. Notably, toxicology reports revealed a potent combination of drugs used in wildlife sedation — butorphanol, azaperone, and medetomidine — present in her bones.

One of these drugs, butorphanol, showed signs of metabolization, indicating Suzanne had ingested the sedatives while alive.

Investigators also discovered that Barry Morphew had access to the sedative cocktail — referred to as BAM — from his time as a deer farmer in Indiana. No other private individuals in the region had access to BAM at the time of Suzanne’s disappearance.

“Ultimately, the prescription records show that when Suzanne Morphew disappeared, only one private citizen living in that entire area of the state had access to BAM: Barry Morphew,” the grand jury indictment concluded.

Defense Fights Back

Barry Morphew’s attorney, David Beller, criticized the renewed prosecution:

“Yet again, the government allows their predetermined conclusion to lead their search for evidence… Barry maintains his innocence. The case has not changed, and the outcome will not either.”

This is not Barry’s first legal battle. He was previously charged in 2021, but the case was dismissed the following year due to prosecutorial missteps.

A judge had barred key witnesses after the state failed to turn over exculpatory evidence, including unknown male DNA found in Suzanne’s SUV.

  • May 10, 2020 – Suzanne Morphew reported missing on Mother's Day.
  • May 2021 – Barry Morphew charged with her murder.
  • April 2022 – Charges dropped without prejudice.
  • September 2023 – Suzanne's remains discovered near Moffat.
  • July 2024 – Barry re-arrested following new indictment.

Community Reaction and What’s Next

Former attorney Iris Eytan, who defended Barry in 2021, stood by her earlier statements:

“Not only is he a loving father, but he was a loving husband… Prosecutors fumbled this case.”

Investigators maintain that Barry misled them during initial questioning and withheld information about his movements. He had initially failed to disclose driving past the area where Suzanne’s helmet was later found.

The discovery of Suzanne’s remains, and the damning toxicology report mark a turning point in a case that has gripped the nation for years. Prosecutors, armed with new forensic evidence and a fresh grand jury indictment, are now preparing to try the case again.

The legal battle surrounding Suzanne Morphew’s death will be returning to court. And hopefully there will be answers to her murder.
