California Landlord Agrees to $28M Settlement for Withholding Security Deposits Exposing Tenant Abuses Statewide

What California Renters Need to Know

  • Essex Property Trust agrees to $19.25 million in cash and $8.7 million in debt forgiveness over disputed security-deposit deductions.
  • Tenants allege inflated contractor bills, undocumented repairs, and charges for work never performed.
  • California law gives renters powerful protections against improper deductions, including additional damages for bad-faith withholding.

SACRAMENTO, Calif. — A California apartment giant has agreed to a nearly $28 million settlement after former tenants accused it of improperly withholding security deposits, inflating repair bills, and charging residents for work that, in some instances, allegedly never happened.

The proposed settlement involving Essex Property Trust includes $19.25 million in cash and $8.7 million in forgiven move-out debt. More than 200,000 former tenants could benefit, although the agreement still requires judicial approval.

But the allegations raise a much larger question. How many California landlords, including smaller operators throughout Sacramento, Elk Grove, and surrounding communities, routinely withhold tenants' deposits knowing that few renters will spend the time and money necessary to challenge them?

That question deserves attention because the economic incentive is obvious. A landlord who improperly keeps $1,500 from one departing tenant may face little resistance. Repeat that practice across dozens or hundreds of properties, however, and the money adds up quickly.

The lawsuit, Norman v. Essex Property Trust, Inc., San Diego Superior Court Case No. 37-2022-00038519-CU-NP-CTL, was originally filed September 27, 2022. Plaintiffs alleged violations of California Civil Code Section 1950.5 and the state's Unfair Competition Law.

Among the allegations was a particularly revealing example involving a San Fernando tenant who reportedly received a carpet-replacement charge approaching $2,000. When he obtained the contractor's actual invoice, the amount was only $907.

Another tenant at Essex's Form 15 apartments in downtown San Diego allegedly received a $550 painting charge despite the company having no corresponding record of the work. She was also charged for carpet cleaning, although her apartment had concrete floors.

These were allegations, not judicial findings. Essex denies wrongdoing. Nevertheless, they expose how difficult it can be for tenants to verify charges when landlords control the invoices, maintenance records, and final accounting.

California lawmakers have already established safeguards against precisely this kind of conduct.

Under Civil Code Section 1950.5, landlords generally must return remaining deposits and provide an itemized accounting within 21 calendar days after a tenant vacates. Deductions cannot be used to make tenants pay for ordinary wear and tear.

Beginning in April 2025, additional photographic documentation requirements took effect. Landlords generally must photograph a vacated unit before and after performing cleaning or repairs for which deductions are claimed. The law also requires supporting bills, invoices, or receipts, subject to specified exceptions.

Perhaps the law's most overlooked provision is its financial penalty. A landlord who retains security deposits in bad faith may face statutory damages of up to twice the deposit amount, in addition to actual damages. The landlord also bears the burden of establishing the reasonableness of disputed charges.

These protections apply beyond large corporate apartment complexes.

Across Sacramento County, including Elk Grove, tenants facing disputed deposits may encounter similar allegations involving excessive cleaning fees, fabricated damages, undocumented repairs, or withheld refunds. Such conduct must be evaluated against the evidence in each case, regardless of whether the landlord owns hundreds of apartments or only a handful of rental homes.

Importantly, California's security-deposit statute also permits qualifying disputes to be brought in small claims court. Tenants need not automatically abandon their money simply because hiring an attorney would cost more than the deposit itself.

Essex's proposed settlement goes further than cash reimbursement. According to plaintiffs' attorneys, the company has agreed to improve vendor documentation, pass contractor discounts through to tenants, provide employee training, and correct applicable negative credit reporting.

The court is scheduled to consider preliminary approval on November 13, 2026. Until approval is granted, the settlement remains proposed, and eligible former tenants should await official claims instructions.

For renters who suspect their deposits were improperly withheld, preserving photographs, lease agreements, correspondence, payment records, and move-out statements may prove critical.

The larger issue is accountability. California already has laws governing security deposits. The question is whether landlords comply with them—and whether tenants have a realistic opportunity to enforce those rights.
