SAN DIEGO, CA - A California computer user has launched a legal battle against Microsoft Corporation, claiming the company's decision to end Windows 10 support constitutes an unfair business practice designed to force millions of consumers into unnecessary hardware upgrades while positioning Microsoft to dominate the artificial intelligence market.

Lawrence Klein, a San Diego County resident, filed the complaint on August 7, 2025, in San Diego Superior Court, seeking public injunctive relief under California's Unfair Competition Law, False Advertising Law, and Consumer Legal Remedies Act. The lawsuit paints a picture of corporate strategy that allegedly prioritizes market control over consumer welfare.

The Core Allegations

According to the 28-page complaint, Microsoft announced less than a year ago that it would cease providing support for Windows 10 devices as of October 14, 2025, despite the operating system representing "more than half of the Windows operating system market share." The lawsuit states that an estimated 240 million devices currently lack the hardware specifications required to upgrade to Windows 11.

Klein's legal team argues that Microsoft's timing is strategically calculated. The complaint alleges: "Microsoft's decision to discontinue support for Windows 10 while most of its consumer base was still using it was part of the company's larger strategy to force its customers to purchase new devices optimized to run Microsoft's suite of generative artificial intelligence (AI) software such as Copilot, which comes bundled with Windows 11 by default."

The lawsuit contends that this represents a departure from historical precedent. Previous Windows phase-outs typically occurred 7-8 years after the next version launched, and only after user adoption had declined significantly. Windows 10 support is ending just 4 years after Windows 11's launch, while over 50% of users still rely on the older system.

Hardware Requirements and Market Control

A central element of Klein's case focuses on Windows 11's unprecedented hardware requirements. The complaint notes that many Windows 10 devices cannot upgrade due to requirements for "Intel 8th Gen Coffee Lake or Zen 2 CPUs and up, TPM 2.0 (Trusted Platform Module) support, 4GB of RAM, and 64GB of storage."

The lawsuit alleges Microsoft has "actively blocked Windows 10 PCs released before late 2017 from receiving the Windows 11 update, forcing users to buy new laptops or desktops if they want the newest Microsoft OS." Furthermore, the complaint states Microsoft "has actively sought to prevent workarounds to move ineligible hardware to Windows 11."

Klein argues this creates a captive market for Microsoft's AI ambitions. The complaint explains: "To run optimally, Microsoft's AI must offload work from the cloud locally to neural processing units (NPU) installed in newer devices. Windows 10 devices generally lack NPUs."

Financial and Environmental Consequences

The lawsuit details the financial burden placed on consumers and businesses. Those unable to upgrade face the choice of purchasing new hardware or paying for Extended Security Updates at $30 per year for individuals and $61 per device for businesses in the first year, escalating to $244 by the third year.

Beyond individual costs, the complaint addresses broader implications for businesses running specialized systems. The lawsuit states: "Numerous business-critical systems—including point-of-sale (POS) terminals and computer numerical control (CNC) machines—operate on custom software developed specifically for the Windows 10 operating environment."

Environmental concerns also feature prominently in the legal challenge. The complaint warns of "an estimated 240 million PCs becoming e-waste," noting that if stacked, discarded laptops would create "a pile 600km taller than the moon."

Cybersecurity Risks and Public Safety

Klein's lawsuit raises alarm about cybersecurity implications, arguing that Microsoft's strategy will leave millions of users vulnerable to cyberattacks. The complaint notes that cybersecurity incidents cost the U.S. economy between $57 billion and $109 billion annually, and warns that "the premature discontinuation of Windows 10 support will likely exacerbate these financial losses."

The lawsuit emphasizes that security risks extend beyond Windows users themselves: "Even individuals who do not use Windows or own a computer are at risk of having their personal data compromised, as businesses that store customer information on Windows 10 systems will be increasingly vulnerable to cyberattacks."

AI Market Competition Claims

A significant portion of the complaint focuses on alleged anticompetitive behavior in the artificial intelligence sector. Klein argues that Microsoft's partnership with OpenAI, combined with forced hardware upgrades, creates an unfair advantage in the AI market.

The lawsuit states: "Microsoft's Azure was the exclusive cloud provider for OpenAI workloads. Hence, Microsoft controlled the compute layer powering its models. That meant any developer, enterprise, or consumer using OpenAI's API was ultimately routed through Azure infrastructure."

According to the complaint, this strategy has proven successful, with "OpenAI and Microsoft together controlled about 69% of the global generative AI market" as of the end of 2023, while the next largest competitor held only 8%.

Legal Remedies Sought

Klein seeks several forms of injunctive relief, including:

• Requiring Microsoft to continue Windows 10 support without additional fees until the operating system falls below 10% of total Windows users
• Mandating clear disclosures about end-of-support dates and consequences at the point of purchase
• Relaxing Windows 11 hardware requirements to allow existing Windows 10 devices to upgrade
• Providing Extended Security Updates without additional charges

The lawsuit also requests that Microsoft's advertising practices be reformed to include transparent information about software lifecycle limitations and security implications.

Microsoft's Market Position

The complaint notes that Microsoft's strategy appears to be financially successful, with the company reaching "a record high stock price of $490.11" as of June 24, 2025, and achieving a market capitalization of $3.896 trillion.

Klein's legal team points to Microsoft's own promotional materials as evidence of the company's intent. The lawsuit quotes a June 2025 full-screen advertisement stating: "With support for Windows 10 ending on October 14, 2025, rest assured we have you covered.… Level up to the new Copilot+PCs."

Industry Implications

The case could have broader implications for software lifecycle management across the technology industry. The complaint suggests that if successful, the lawsuit could establish precedent requiring tech companies to provide clearer disclosures about planned obsolescence and support timelines.

Klein's attorney argues that current practices violate multiple California consumer protection statutes by failing to adequately inform consumers about the true costs and limitations associated with software purchases.

As the October 2025 deadline approaches, millions of Windows 10 users face decisions about hardware upgrades, extended support purchases, or alternative operating systems.
