Comey Hit With Federal Charges Over Instagram Post Allegedly Threatening Trump

A viral image. A cryptic number. A criminal charge that could carry years in prison.

Former FBI Director James Comey now finds himself at the center of a high-stakes legal battle after being charged with threatening the life of US President Donald Trump. The accusation stems from a now-deleted Instagram post showing seashells arranged into the numbers "86 47" a seemingly simple image that has ignited a political and legal firestorm.

At the heart of the case is interpretation. To some, the number "86" is harmless slang meaning to remove or discard. To others, including Trump and key officials, it signals something far more dangerous when paired with "47," a reference to the current president.

Comey pushes back

Comey has firmly denied any malicious intent, maintaining that he did not understand the numbers to carry violent meaning.

"I'm still innocent, I'm still not afraid, and I still believe in the independent federal judiciary."

His defense hinges on that claim of ignorance and on the broader protection of free speech. Still, federal prosecutors are pressing forward.

FBI and DOJ escalate

At a tense press conference, FBI Director Kash Patel accused Comey of knowingly crossing a line.

"James Comey disgracefully encouraged a threat on President Trump's life and posted it on Instagram for the world to see."

Acting Attorney General Todd Blanche reinforced the seriousness of the charges.

"Threatening the life of the President of the United States is a grave violation of our nation's laws. The grand jury returned an indictment alleging James Comey did just that."

Comey now faces two federal charges, making a threat against the president and transmitting a threat in interstate commerce. Each carries a potential sentence of up to 10 years in prison.

A long-running feud reignites

This is not just a legal case. It is the latest chapter in a years-long conflict between Trump and the man he fired during his first term.

Comey was dismissed after launching an investigation into Russian interference in the 2016 election. Since then, Trump has repeatedly called for his prosecution.

Tuesday’s indictment marks the administration’s second attempt to bring charges against him.

"Well, they're back. This time about a picture of sea shells on a North Carolina beach a year ago. And this won't be the end of it, but nothing has changed with me."

The post that sparked it all

The controversial image was posted last year and quickly taken down after backlash. Comey later explained his reasoning.

"I assumed [the sea shells] were a political message."

"I didn't realise some folks associate those numbers with violence. It never occurred to me but I oppose violence of any kind so I took the post down."

Despite that explanation, Trump dismissed the defense outright.

"a child knows what that meant"

Legal experts raise red flags

The indictment is already drawing sharp criticism from constitutional scholars and former prosecutors who question both its strength and its motives.

"It's very thin," said Michael Gerhardt, a constitutional law expert.

He added that courts are likely to view the post as protected speech under the First Amendment.

Others were even more blunt.

"The DOJ will not be able to prove beyond a reasonable doubt that James Comey had the intent to threaten or harm President Trump," said former federal prosecutor Jimmy Gurulé. "The indictment is a transparent attempt to intimidate one of the President's perceived political enemies."

He went further, calling the case "an embarrassment to the American criminal justice system."

A pattern of legal clashes

This is not Comey’s first encounter with federal charges. Last year, he was indicted over allegations that he lied to Congress and obstructed proceedings.

That case collapsed quickly.

A federal judge dismissed the indictment, citing an "invalid" appointment of the prosecutor who brought the charges. The ruling left open the possibility for the government to try again.

Now, with a new case and renewed political pressure, that door has clearly been reopened.

More turmoil in the background

Adding another layer to the unfolding drama, a separate ruling on Tuesday allowed Maurene Comey, the former prosecutor and daughter of James Comey, to proceed with her legal challenge against her dismissal by the Trump administration.

What comes next

The case is expected to test the boundaries between free speech and criminal threat, while raising broader questions about political power, retaliation, and the use of federal prosecution.

At stake is more than one man’s future. The outcome could shape how speech, intent, and political expression are judged at the highest levels of the justice system.
