Davis Polk & Wardwell Rescinds Job Offers Over Alleged Support for Hamas

New York — Davis Polk & Wardwell LLP has taken a decisive step by rescinding job offers to three aspiring law students. These students held leadership roles in organizations affiliated with prestigious institutions like Harvard University and Columbia University. The cause of this unprecedented move? Alleged endorsements of controversial statements, shifting blame onto Israel for the October 7 actions of the Hamas terrorist group.

Davis Polk's Chair, Neil Barr, made this announcement through an internal email that was later obtained by Law360. The email did not disclose the identities of the affected students or the specific contentious statements. However, it emphasized that these statements were in direct contradiction with the firm's core values.

"These statements are simply contrary to our firm's values, and we thus concluded that rescinding these offers was appropriate in upholding our responsibility to provide a safe and inclusive work environment for all Davis Polk employees," Barr stated in the email. "At this time, we remain in dialogue with two of these students to ensure that any further context offered by these students is considered."

Furthermore, the email highlighted that the rescission of job offers is in line with the firm's commitment to maintaining a supportive and inclusive work environment. These actions signify that the students are no longer welcome at Davis Polk.

Despite inquiries, representatives of Davis Polk did not immediately respond to requests for comment on this matter.

This development comes in the wake of Winston & Strawn LLP confirming that they revoked a job offer to a former summer associate and former New York University School of Law Student Bar Association President, Ryna Workman. The firm contended that Workman had circulated "inflammatory comments" concerning Hamas' recent attack on Israel.

The New York Post reported that Workman, using they/them pronouns, conveyed "absolute solidarity with Palestinians in their resistance against oppression" in a message to the NYU Law Student Bar Association. They also stated that "Israel bears full responsibility for this tremendous loss of life." This message ignited swift online backlash, including criticism from the nonprofit watchdog organization StopAntisemitism, which claimed that Workman lost their job offer for "penning a horrifying justification for the murder, rape, and kidnapping of Jews" in a school newsletter.

At the same time, the ongoing complex international conflict in the Gaza Strip has escalated dramatically. This escalation was triggered by the October 7 attack by Hamas, a group designated as a terrorist organization by the U.S. government. In this attack, Hamas fighters reportedly killed over 1,400 civilians and soldiers in Israel, with nearly 200 individuals taken hostage.

In response to this attack, Israel initiated a bombing campaign and imposed severe restrictions on the Gaza Strip, including cutting off water, power, and fuel supplies.

The American-Arab Anti-Discrimination Committee and the Arab American Civil Rights League filed a lawsuit on Monday. They assert that the Israeli bombing campaign has transformed the Gaza Strip into an active war zone. They also accuse the U.S. government of discrimination by evacuating U.S. citizens from Israel while not doing the same for Palestinian Americans in Gaza.

U.S. President Joe Biden, in light of these events, boarded Air Force One on Tuesday with a destination of Tel Aviv. However, a planned visit to Jordan was canceled after reports emerged that the Al Ahli Arab Hospital in Gaza was bombed, resulting in the deaths of hundreds of civilians inside. Israeli and Palestinian officials traded blame for the explosion.

In a White House statement issued after the bombing, President Biden expressed his outrage and deep sadness over the incident. He directed his national security team to continue gathering information about the event. In recent days, President Biden has strongly condemned Hamas' terrorist attack on Israel while affirming the U.S. government's support for Israel. He also emphasized that Hamas does not represent the Palestinian people's right to dignity and self-determination.

"The United States stands unequivocally for the protection of civilian life during conflict, and we mourn the patients, medical staff, and other innocents killed or wounded in this tragedy," the White House stated in a press release on Tuesday.
