EEOC Sues New York Times for Allegedly Discriminating Against White Male Editor in Favor of DEI Goals

EEOC sued NYT for discrimination

In a significant escalation of the Trump administration’s scrutiny of corporate diversity practices, the U.S. Equal Employment Opportunity Commission has filed a federal lawsuit against The New York Times, accusing the media giant of bypassing a qualified white male editor for promotion explicitly because of his race and sex.

The lawsuit, filed Tuesday, centers on an experienced editor who has worked at the Times since 2014 and served as senior staff editor on the paper’s international desk for more than nine years. According to the EEOC, the employee was passed over for the position of Deputy Real Estate Editor in early 2025, despite being “significantly” more qualified and meeting every requirement for the role.

The Allegations

The complaint is blunt: no white males were among the four finalists for the position. The job ultimately went to Monica Burton, who joined the Times from Vox Media’s Eater. The lawsuit claims the Times’ diversity initiatives directly influenced the decision, stating that the employee “did not match the race and/or sex characteristics NYT sought to increase in its leadership.”

It further alleges the paper’s push to boost the percentage of non-White and female leaders necessarily meant reducing the number of White males in key roles. The EEOC argues these actions were carried out “with malice or with reckless indifference” to the employee’s civil rights under Title VII of the Civil Rights Act of 1964.

The employee first filed a charge with the EEOC, which found “reasonable cause” to believe discrimination had occurred before moving forward with the lawsuit. The commission is seeking backpay with interest and other remedies.

NYT Fires Back

The New York Times strongly denied the allegations, calling them “politically motivated” and vowing to defend itself vigorously.

In a statement, spokesperson Danielle Rhoades Ha said: “Our employment practices are merit-based and focused on recruiting and promoting the best talent in the world… Neither race nor gender played a role in this decision — we hired the most qualified candidate.”

The Times described the EEOC’s involvement as highly unusual and accused the agency of deviating from standard practices to push a predetermined narrative.

A Larger Pattern Emerging

This case is not happening in isolation. It reflects a growing pushback against the aggressive DEI policies many media organizations adopted after 2020. Several major outlets have already begun quietly scaling back or dismantling race-and-culture units and diversity quotas.

The lawsuit arrives amid broader tensions between the Trump administration and legacy media. Just last week, FCC Chair Brendan Carr took aggressive action against ABC stations, citing DEI concerns — moves that signal employment and diversity practices at major media companies could become a new front in the ongoing culture and regulatory battles.

The Real Story

At its core, this lawsuit raises uncomfortable questions about whether “diversity” initiatives have crossed the line into outright racial and gender discrimination — something Title VII was originally designed to prevent. When a major journalistic institution like The New York Times is accused of systematically sidelining qualified candidates based on race, it doesn’t just harm the individuals passed over — it undermines public trust in the institution itself.

This case may ultimately force a long-overdue reckoning: Can organizations pursue diversity without violating the law and basic principles of fairness?

The answer could reshape hiring practices across the American media industry for years to come.
