Eve Legal Strikes Back Seeking To Invalidate AI.Law’s AI Document Drafting Patent

A high-stakes patent battle between two legal technology companies has shifted from accusations of infringement to a more fundamental question—can a company patent the use of artificial intelligence to transform unstructured information into finished legal documents?

San Francisco-based Butler Labs Inc., which operates as Eve Legal, asked a California federal judge to dismiss a lawsuit filed by Ohio-based competitor AI.Law. Eve argues that the patent at the center of the case is invalid because it claims little more than the conventional use of AI to collect, organize and present information.

Eve characterized the disputed invention as a quintessential “do it using AI” patent—not a genuine technological breakthrough entitled to federal protection.

The motion was filed Aug. 31 in the U.S. District Court for the Northern District of California. The case is assigned to U.S. District Judge Rita F. Lin. No ruling has been issued.

AI.Law’s Patent Under Fire

AI.Law sued Eve in June, alleging that Eve’s document-generation platform infringes U.S. Patent No. 12,461,932, titled “Method and System for Transforming Data Using Artificial Intelligence to Generate Content.”

Issued in November 2025, the patent contains 20 claims. Its principal claim describes receiving unstructured data, using a large language model and parsing algorithm to convert that material into structured information, and generating a document through an AI engine.

The technology also addresses situations in which a large language model stops drafting because it reaches an output limit. The claimed system can re-execute a prompt with the partially generated document and continue producing content.

AI.Law alleges Eve uses substantially similar methods to generate legal complaints, discovery responses, medical chronologies and other litigation materials. The company is seeking unspecified monetary damages for the alleged infringement.

Eve, however, maintains that the patent merely places familiar information-processing activities into a generic AI environment.

The Alice Test Takes Center Stage

Eve’s challenge invokes Section 101 of the Patent Act, which governs what types of inventions qualify for patent protection.

Under the U.S. Supreme Court’s landmark decision in Alice Corp. v. CLS Bank International, courts apply a two-part test to patents involving software or computer-implemented processes. A court first determines whether the claims are directed toward an abstract idea. If they are, the court then asks whether the patent contains an “inventive concept” sufficient to transform that idea into a patent-eligible application.

Simply directing a conventional computer—or an AI model—to perform an established intellectual task is ordinarily insufficient.

Eve argues that AI.Law’s claims amount to collecting data, analyzing it and generating a document, all performed with conventional computing tools. AI.Law will have an opportunity to argue that its claimed workflow, feedback mechanisms and document-generation architecture provide a concrete technical improvement rather than an abstract drafting process.

The court must evaluate the patent’s actual claims, not merely the broad commercial concept behind the product. Moreover, AI.Law’s allegations remain unproven, while the patent carries a statutory presumption of validity unless successfully challenged.

A Case With Industrywide Consequences

The lawsuit arrives as law firms rapidly adopt AI for drafting motions, demands, pleadings and discovery. Eve offers AI tools primarily to plaintiffs’ firms, while AI.Law promotes more than 30 tools for legal drafting and litigation support.

If AI.Law’s patent survives, the decision could strengthen protection for specialized legal AI workflows and expose competing platforms to licensing demands or infringement claims. If Eve succeeds, the ruling may reinforce a critical boundary—using generative AI to automate a familiar professional task does not, standing alone, create a patentable invention.

The case is www.ai.law Corp. v. Butler Labs Inc., No. 3:26-cv-05930, in the Northern District of California. The federal docket confirms the motion remains pending.
