FDA Approves First Fruit-Flavored E-Cigarettes for Adults, Igniting Fierce Tobacco Policy Battle

WASHINGTON — The U.S. Food and Drug Administration has issued its first authorization for fruit-flavored electronic cigarettes intended for adult smokers, marking a major policy shift that is already expected to spark a national fight over youth vaping, tobacco regulation, and public health.

The move comes after months of pressure from vaping industry groups urging President Donald Trump’s administration to relax restrictions. It lands at a moment when teen vaping rates have fallen to a 10-year low, giving manufacturers fresh momentum to argue that flavored products should remain on the market for adult use.

A high-stakes shift in vaping policy

The decision is likely to face immediate backlash from health organizations and parent advocacy groups, which have long blamed flavored e-cigarettes for driving youth addiction across the United States.

At the same time, vaping companies continue to argue their products help reduce cigarette smoking among adults, a habit linked to roughly 480,000 deaths annually from cancer, lung disease, and heart disease.

E-cigarettes have been sold in the United States since 2007, but their public health promise has been overshadowed for years by widespread use among middle and high school students.

New flavors, new controversy

The newly authorized products include mango, blueberry, and two menthol varieties. Los Angeles-based company Glas Inc. plans to market them under the names Gold, Sapphire, Classic Menthol, and Fresh Menthol, according to the FDA announcement.

Previously, the agency had only approved tobacco and menthol-flavored vaping products. Most authorized e-cigarettes have come from major manufacturers such as Juul and Altria.

The FDA emphasized that Tuesday’s action is not an endorsement. The agency stressed that the products are intended only for adults who are trying to quit or reduce cigarette use.

Strict digital age controls

The FDA pointed to Glas Inc.’s digital verification system as a key safeguard against youth access. Users must confirm their age using a government ID on their phone. The devices are then locked and can only operate when connected via Bluetooth to the verified user’s smartphone.

Public health warnings intensify

The FDA’s approval is expected to become a flashpoint.

"Ultimately, it's critical that we remain vigilant in protecting young people, including closely monitoring the use of authorized products," said Kathy Crosby of the Truth Initiative, a leading anti-tobacco organization.

The group warned that the decision could become a “key test case” for future flavored vape approvals and youth exposure risks.

Trump-era vaping politics resurface

As a presidential candidate, Donald Trump pledged to "save" vaping, earning strong support from vaping companies, retail shop owners, and users.

Under President Joe Biden, the FDA rejected more than one million applications for candy and fruit-flavored products, part of a sweeping crackdown credited with helping reduce teen vaping after a major surge in 2019.

During Trump’s first term, his administration introduced the first federal flavor restrictions on e-cigarettes and raised the legal purchasing age for all tobacco products from 18 to 21.

Regulatory priorities shift at FDA

Vaping policy has taken a back seat under FDA Commissioner Marty Makary, who has focused on other initiatives including tighter oversight of COVID-19 vaccines, efforts to phase out artificial food dyes, and faster approval pathways for certain experimental drugs.

Industry groups, including the Vapor Technology Association, have recently met with administration officials to push for broader access to flavored products.

In March, the FDA issued new guidance suggesting that flavors such as menthol, coffee, mint, and spice may play a role in helping adult smokers transition away from cigarettes. However, it also reaffirmed concerns that sweeter flavors like fruit, candy, and dessert varieties are more likely to attract teenagers.

Teen vaping remains a central concern

Despite regulatory progress, federal data shows most teens who vape still use unauthorized fruit- and candy-flavored products. While technically illegal, these devices remain widely available in low-cost disposable formats, often imported from China.

The FDA’s approval of fruit-flavored vapes now sets up a high-stakes policy test, with regulators, health advocates, and the vaping industry all watching closely to see whether expanded adult access could unintentionally reignite youth usage across the country.
