[FLORIDA] - In a twist that could rival the punchline of a groan-worthy dad joke, Broward County Circuit Court Judge Gary M. Farmer Jr. finds himself suspended from the bench, effective midnight on Monday, May 19, 2025. The Florida Judicial Qualifications Commission (FJQC) delivered the gavel’s blow, citing a litany of infractions: “exceptionally bad” courtroom humor, biased conduct, excessive absences, and a failure to uphold due process. The decision, handed down after months of investigation, paints a vivid picture of a judge whose attempts at levity landed him in hot water, sparking a broader conversation about the line between humanity and impropriety in the judiciary.

The saga began in October 2024, when the FJQC’s Investigative Panel launched a probe into Farmer’s courtroom conduct. By December, a probable cause hearing solidified the panel’s concerns, and last month, they recommended his suspension. The Florida Supreme Court’s advisory panel sealed Farmer’s fate, declaring him unfit to serve due to behavior that “damaged the public’s perception of the judiciary.” Court filings reveal a colorful array of incidents, from cringe-inducing puns to remarks that veered into inappropriate territory, leaving litigants, attorneys, and observers questioning the solemnity of Farmer’s courtroom.

A Courtroom Comedy of Errors

Picture this: a felony case on August 15, 2024, where a defendant stands before Farmer, nervously awaiting his fate. The man, expecting the birth of three children with different women, becomes the unwitting target of Farmer’s humor. “OK, you’ve been busy. You were just shooting all over the place!” Farmer quipped, according to court documents. “That’s good. Do you know their names? First and last? Romantic, are you? Don’t tell Susie about Jane. Don’t tell Jane about Mary. God bless you, man. One’s enough.”

The jest didn’t stop there. Farmer, presiding over the same case, allegedly told the defendant he’d be placed on pretrial release with a peculiar condition: “I’m going to order that you wear a condom at all times. For your own good, OK? Probation is going to check. No, I’m kidding. I’m kidding.” Later, he recommended a female attorney to the defendant, adding a warning not to “get her pregnant.” The remarks, described by Farmer’s attorney as attempts to “lighten tension,” and bring a little “humanity” to the room, struck a sour note with the FJQC, who saw them as undermining the court’s dignity.

Farmer’s comedic repertoire extended beyond this case. While presiding over State v. Georgia Smith, he reportedly serenaded the defendant with a rendition of “Sweet Georgia” and urged her to say “peachy” or sing about “peaches down in Georgia” and “weed in California.” He even apologized to an attorney for trying to make him laugh, admitting it was a “challenge.” In another instance, Farmer quoted extensively from an In Living Color sketch mocking gay people, later claiming he forgot his microphone was on. The FJQC wasn’t amused, citing these incidents as part of a pattern of misconduct.

And then there were the dad jokes. On August 15, 2024, Farmer reportedly declared, “Spring is here. I got so excited I wet my plants,” followed by, “What did the shirt say to the pair of pants? Wassup britches!” The court filing dryly noted these as part of Farmer’s self-proclaimed “exceptionally, exceptionally bad jokes,” which the panel deemed inappropriate for a judicial setting.

Beyond the Punchlines: Serious Allegations

While Farmer’s humor drew headlines, the FJQC’s concerns ran deeper. The panel accused him of failing to devote full time to his judicial duties, exceeding his allotted 30 days of leave. More troubling were allegations of bias and denial of due process, with Farmer reportedly showing predetermination in certain cases. These charges, combined with his comedic missteps, painted a picture of a judge whose conduct eroded public trust in the judiciary.

Farmer, a former Florida state senator and Democrat, wasn’t without defenders. His attorney filed a response to the suspension recommendation, arguing that the judge’s jokes were “G-rated dad jokes” meant to reduce stress for defendants and show humanity. “They generally are corny but not offensive and were not degrading to the solemnity of the proceedings,” the attorney wrote. However, Farmer conceded that some remarks, particularly the “racy” ones, were inappropriate. During a probable cause hearing, he apologized, a sentiment he reiterated through his counsel.

The In Living Color incident, Farmer claimed, was an accidental broadcast due to a live microphone, and he expressed regret for the remarks. Yet the FJQC remained unmoved, emphasizing the cumulative impact of Farmer’s actions over time. “Through his extensive misconduct, occurring over a lengthy period of time, Judge Farmer has damaged the public’s perception of the judiciary and the judicial branch,” the panel stated.

A Broader Debate on Judicial Decorum

Farmer’s suspension raises thorny questions about the role of humor in the courtroom. Judges often walk a tightrope, balancing authority with approachability. A well-timed quip can humanize proceedings, easing the tension for defendants facing life-altering consequences. But where is the line? Farmer’s case suggests that humor, when misjudged, can alienate litigants, undermine fairness, and erode the court’s gravitas.

Legal scholars point to the Code of Judicial Conduct, which governs Florida judges. Canon 3B(4) requires judges to be “patient, dignified, and courteous” to all parties. Farmer’s remarks, particularly those targeting a defendant’s personal life or referencing stereotypes, arguably violated this standard. Yet some argue the FJQC’s response—suspension without pay—is disproportionate for what Farmer’s attorney called “corny” jokes. The debate echoes broader discussions about judicial accountability, especially in an era where public scrutiny of the courts is at an all-time high.

What’s Next for Farmer?

As Farmer awaits a disposition hearing, his future on the bench hangs in the balance. The suspension, effective at 11:59 p.m. on May 19, 2025, bars him from judicial duties without compensation. The FJQC’s final ruling could range from reinstatement with conditions to permanent removal, depending on the hearing’s outcome. For now, Broward County’s judiciary must navigate the fallout, with other judges likely stepping in to cover Farmer’s docket.

The case also serves as a cautionary tale for jurists nationwide. In a profession steeped in tradition, where black robes symbolize impartiality, Farmer’s foray into comedy underscores the risks of straying from decorum. As one Florida attorney, speaking anonymously, put it: “Judges aren’t stand-up comedians. They’re arbiters of justice. Farmer forgot that, and now he’s paying the price.”
