Jury Hits NaphCare With $25M Over Inmate’s Lost Leg

In a thunderous verdict that reverberated across the correctional healthcare sector, a Seattle federal jury has ordered NaphCare Inc. to pay $25 million to an inmate whose leg was amputated after what he alleged was a shocking neglect of medical care inside a Washington county jail. The NaphCare $25M Verdict comes after a gripping 10-day trial and more than eight hours of jury deliberation, exposing what plaintiffs argued was a culture of profit over patient care.

The jury on Friday found that the company, contracted to provide medical services at the Pierce County Jail, violated Javier Tapia’s constitutional rights by failing to treat his deteriorating condition stemming from blood clots. Tapia, now permanently disabled, accused NaphCare of systemic failure—and the jury agreed.

The Damning Details: Constitution Violated, Customs Questioned

Jurors concluded that NaphCare’s staff not only neglected Tapia’s needs but did so in alignment with a “widespread or longstanding custom,” implicating the company’s institutional practices. The award includes $5 million in compensatory damages and a staggering $20 million in punitive damages—designed to send a message.

Tapia’s legal team painted a chilling picture: Licensed practical nurses allegedly operated beyond their training, guards were tasked with monitoring medical conditions, and communication between medical and mental health professionals was alarmingly poor.

“This verdict is about accountability,” said Ryan Dreveskracht of Galanda Broadman PLLC, who represented Tapia. “For Javier, this is one step toward ensuring that this never happens again to anyone incarcerated in our jails.”

The Human Toll: A Leg Lost, A Voice Silenced

Tapia’s journey into medical crisis began in September 2018, three months after being booked into Pierce County Jail on suspicion of vehicle theft and prior warrants. While in solitary confinement, his physical and mental health spiraled. Jail mental health staff documented troubling symptoms, yet NaphCare never intervened—until it was far too late.

On October 1, 2018, a corrections officer noticed Tapia’s foot had turned black. A nurse described it as “suspected gangrene.” By the time Tapia reached Tacoma General Hospital, his foot was decaying and beyond saving. Doctors later amputated the leg below the knee after discovering hardened veins and additional clotting.

“He couldn’t speak, couldn’t alert anyone. His body was failing him, and the system failed him too,” said Dreveskracht.

NaphCare’s Defense: A Different Story of Intervention

NaphCare, for its part, pushed back hard. In court filings, the company denied any policy or custom that disregarded inmates’ medical rights. They argued Tapia suffered from phlegmasia cerulea dolens—a rare, deadly vascular condition with swift onset—and claimed he did not report foot problems until October 1. The company maintains that once symptoms were visible, staff acted promptly and saved his life.

"Despite the outcome of this case, we believe in the diligence and professionalism of our team," a NaphCare spokesperson said. "We fundamentally disagree with the outcome and will move forward with appeal."

Behind the Verdict: Systemic Neglect or Rare Tragedy?

The court heard how Tapia’s nonverbal state had lasted for weeks. His lawyer claims that rather than being a case of sudden-onset illness, this was a slow, visible deterioration ignored by medical staff. That silence, Dreveskracht argued, was a cry for help muffled by neglect.

The jury sided with that narrative, holding NaphCare liable for creating—or at least enabling—a system that allowed such oversight to fester.

Legal Landscape: County Settles, But Fight Continues

Tapia also brought negligence claims against Pierce County, though those were dropped after reaching a settlement, court records show. His legal team included Dreveskracht, Corinne Sebren of Galanda Broadman PLLC, and Ed Budge of Budge & Heipt.

NaphCare’s defense was led by attorneys David A. Perez, Juliana Bennington, Shae McPhee, and Jacob Dean of Perkins Coie LLP.

What Comes Next: Appeals and Accountability

As NaphCare signals its intent to appeal, legal analysts say the case has already broken ground in holding private correctional healthcare providers accountable under constitutional standards. The size of the NaphCare $25M Verdict—especially the punitive portion—could ripple through the industry, prompting reassessments of practices and oversight in jails nationwide.

In a system where the voiceless often go unheard, this verdict may have amplified a warning shot that rings far beyond a single courtroom.
