Kellogg North America Co. LLC has filed a trademark infringement lawsuit against an Ohio-based hibachi food truck operating under the name “L’eggo My Eggroll,” citing unauthorized use of its iconic "L'eggo My Eggo" brand elements. The legal action was filed in the U.S. District Court for the Northern District of Ohio on Tuesday, June 3, 2025.

The lawsuit alleges that the food truck’s name, branding, colors, and font bear a striking resemblance to Kellogg’s well-established Eggo trademark and trade dress, creating a high likelihood of consumer confusion. Kellogg contends that the L'eggo My Eggroll truck, based in Findlay, Ohio, has refused multiple cease-and-desist requests and instead made threats and monetary demands, including asking Kellogg to purchase the food truck’s entire business.

In the complaint, Kellogg asserts that the truck’s use of a yellow paint scheme with red cursive lettering mimics the look and feel of Eggo waffle packaging, and that the infringement extends beyond mere naming into full brand imitation. Despite Kellogg's initial goodwill gesture allowing the truck time to rebrand due to its small startup status, the owners have allegedly declined to cooperate.

Kellogg further states that one of the food truck’s principals claimed the company was responsible for medical bills stemming from an alleged reaction to Kellogg’s legal correspondence, though no details were provided.

Given the food truck's continued refusal to leggo the Eggo trademark, Kellogg is now seeking a court order to bar the use of the infringing branding, destroy all infringing materials, and award damages and attorney fees.
