KemperSports, an Illinois-based golf course and hospitality management company, is facing mounting legal trouble as multiple lawsuits have been filed against it following a significant data breach earlier this year. The company, which manages over 140 golf courses, private clubs, sports venues, and resorts nationwide, experienced a breach on April 1 that resulted in the theft of personal information.

This week, two additional federal lawsuits were filed, bringing the total number of cases related to the data breach to at least four. The latest lawsuit was filed by Kentucky resident William Campe, who is seeking damages through a proposed class action in Illinois federal court. Campe’s lawsuit claims the data breach was foreseeable and could have been avoided had KemperSports implemented stronger security measures, such as enforcing stronger passwords, firewalls, and antivirus software, and restricting access to sensitive information.

According to the complaint, Campe was informed of the breach on September 9 and now faces the risk of identity theft. He has spent significant time monitoring his accounts and setting up credit alerts as a result.

“Because of the data breach, plaintiff spent time dealing with the consequences, including verifying the legitimacy of the notice and self-monitoring his accounts to ensure no fraudulent activity occurred. This time has been lost forever and cannot be recaptured,” the lawsuit stated.

Campe's claims include negligence, breach of implied contract, and unjust enrichment. Another proposed class action was filed earlier this week by Kansas resident Kendra Davila, making similar allegations.

Previous and Dismissed Cases

Former KemperSports employee Kelli Seals filed her own proposed class action in September. On the same day, a separate lawsuit by Rachel Getzinger was dismissed by U.S. District Judge Joan B. Gottschall, who ruled that Getzinger’s complaint did not adequately establish the court’s jurisdiction. However, this dismissal was without prejudice, meaning it could be refiled.

The plaintiffs in these cases argue that KemperSports failed to protect personal data and that its negligence has led to potential risks of identity theft for customers and employees.

KemperSports' Response

A spokesperson for KemperSports said in September that the company has implemented additional security measures and notified law enforcement following the breach. However, the company has not commented further on the ongoing lawsuits.
