KJ Biermann

ATLANTA β€” KJ Biermann, the 15-year-old son of reality television personality Kim Zolciak and former NFL player Kroy Biermann, is facing renewed scrutiny after new allegations were disclosed in a court hearing. The previously undisclosed allegations involve a family member younger than 12.

Prosecutors also discussed a separate case in which a 15-year-old female classmate accused the teenager of sexual assault. Biermann and his defense team have denied the allegations.

The revelations emerged during proceedings in Fulton County Superior Court, where Zolciak, Biermann's father and his older sister, Brielle Biermann, attended in support of the teenager. The hearing focused on his detention and the conditions under which he might be allowed to return home while the criminal proceedings continued.

Prosecutors Reveal Allegations Involving a Young Relative

Deputy District Attorney Caitlin McGillicuddy told the court that investigators had allegedly discovered videos on Biermann's cellphone. The videosΒ  reveal sexual encounters involving a family member younger than 12. According to the prosecutor, the recordings allegedly showed multiple encounters and included language she characterized as predatory and derogatory.

McGillicuddy also said Biermann had been under court supervision since October 2025 in connection with a separate juvenile matter stemming from an incident reportedly brought to authorities' attention in April 2023.

The prosecutor described the newly disclosed information as significant because it involved allegations of a sexual nature in addition to the charges arising from the case involving a classmate.

Biermann's attorney, Jason Sheffield, strongly disputed the prosecution's characterization of the earlier juvenile matter. In a statement reported by Page Six, Sheffield said the case involved inappropriate behavior between two middle-school students and did not result in an adjudication for statutory rape, sexual intercourse or a comparable offense.

He argued that descriptions suggesting otherwise were inaccurate and gave the public a misleading impression of the case's outcome.

Seven Felony Charges Stem From Classmate's Allegations

The separate criminal case involves an alleged encounter on April 23 at a Life Time Fitness facility in Alpharetta, Georgia. According to court documents described in media reports, the female accuser, who was 15 at the time, alleged that Biermann, then 14, forced her into sexual activity despite her objections.

The allegations include claims involving a coed sauna and additional unwanted sexual contact. The girl reportedly told her family about the incident the following day and underwent a medical examination at Wellstar North Fulton Medical Center. Reports citing the examination said no male DNA was found in her mouth or vagina.

A grand jury indicted Biermann on seven felony counts, including aggravated child molestation, aggravated sodomy, aggravated sexual battery, additional aggravated sexual battery charges involving a child younger than 16 and false imprisonment.

These charges concern allegations, not findings of guilt. Biermann's defense has maintained that he is innocent and has said he intends to contest the accusations.

Accuser Describes Fear Over Possible Release

During the bond proceedings, prosecutors cited what McGillicuddy described as documented physical injuries to the alleged victim in the classmate case. The state sought strict financial and release conditions, arguing that the allegations and reported threats raised serious safety concerns.

A statement attributed to the girl was read in court. She said she feared for her own safety and that of her family if Biermann were released, describing a continuing sense of fear and concerns about communications that family members had received.

Sheffield, meanwhile, argued that the teenager's age, academic performance, extracurricular involvement and football accomplishments supported his request for release. He also described his client as quiet and said the legal proceedings had been traumatic for him.

The competing arguments underscored the court's responsibility to consider both the defendant's rights and the safety concerns raised by the alleged victim.

Kim Zolciak and Kroy Biermann Attend Hearing

Zolciak and Brielle sat together in the courtroom gallery, while Kroy Biermann sat separately. Their attendance drew attention because of the family's public profile and the ongoing legal challenges facing the teenager.

Zolciak, known for appearing on The Real Housewives of Atlanta, and Kroy, who played in the NFL, share four younger children: KJ, Kash, Kane and Kaia. Kroy also adopted Zolciak's older daughters, Brielle and Ariana, from her previous relationship.

The couple have experienced a contentious divorce, adding another layer of public attention to the family's circumstances. Despite their personal differences, both parents have been present in the broader discussion surrounding their son's case.

Sheffield has urged the public not to treat the allegations as established facts. The defense has emphasized the presumption of innocence and requested privacy for the families involved.

Case Highlights Challenges of Juvenile Proceedings

The case has raised questions about how serious felony allegations involving a teenager are handled in Georgia's court system. Sheffield previously sought to move the proceedings to juvenile court and argued that the defendant's age and ongoing development should be considered when determining how the case proceeds.

The charges carry potentially severe consequences if proven, making the legal decisions surrounding jurisdiction, detention and trial particularly consequential.

The allegations involving the younger relative also introduce a distinct juvenile matter whose reported resolution the defense says has been mischaracterized. The prosecution's account and the defense's response differ substantially, making careful attribution essential as the proceedings continue.

For now, the accusations against Biermann remain allegations. Any determination of criminal responsibility must come through the legal process, rather than public speculation or his family's celebrity status.

A report published Oct. 15, 2026, says Biermann filed a motion asking a judge to reconsider an earlier ruling.
