Lindsay Clancy Retrial in Limbo: Prosecutors Delay Trial Date, Defense Seeks Dismissal Over Holdout Juror in Tense Plymouth Hearing

Lindsay Clancy hearing

PLYMOUTH, Mass. — A contentious Monday hearing in the Lindsay Clancy case left the future of the high-profile Massachusetts child-deaths prosecution uncertain, as prosecutors declined to set a retrial date, the defense pressed a double jeopardy motion to end the case, and the judge and defense counsel traded sharp words in open court.

Clancy, 36, is charged with three counts of first-degree murder in the January 24, 2023 deaths of her children at their home in Duxbury: Cora, 5, Dawson, 3, and Callan, 8 months. She has not denied strangling the children, but has pleaded not guilty by reason of insanity, saying she was suffering from postpartum psychosis and heard a voice demanding she kill her children and herself. Her trial ended in a hung jury and a mistrial on September 4, 2026, according to Boston.com.

Prosecutors Hold Off on a New Trial Date

At the Plymouth Superior Court hearing before Judge William Sullivan, prosecutors said they are not yet ready to schedule a retrial. Assistant District Attorney Jennifer Sprague told the court, "This would be a retrial," and added, "We're not at that point yet." Prosecutors pushed the scheduling question out two weeks while attorneys await several pending rulings from the judge.

Notably, it remains unclear what Clancy would face. Plymouth District Attorney Tim Cruz has not said whether his office will again seek first-degree murder convictions or reduce the charges. Defense attorney Kevin Reddington seized on that ambiguity. "Why do we not know if the next trial is going to be murder in the first degree or a lesser charge, or no charge?" he asked.

The Double Jeopardy Gambit

The centerpiece of the hearing was a defense motion to dismiss the charges on double jeopardy grounds, argued by appellate specialist Martin Weinberg. The defense contends there was no "manifest necessity" for declaring a mistrial because Judge Sullivan, they say, should have probed a holdout juror's fitness more deeply before ending the trial. The judge appeared skeptical, calling the circumstances "significantly different" from what the defense described and asking, "Didn't I do that?" He took the motion under advisement.

Prosecutors countered that the juror "did not refuse to deliberate; he refused to agree," and called the judge's handling of the deliberations a "balanced response."

A Clash Over the Holdout Juror

The mistrial followed a single holdout, identified as Michael Desronvil, who has said he had no doubt Clancy was guilty. Reddington argued in court that Desronvil was "scrolling through his cellphone" during deliberations, looked up terms related to filicide, and failed to disclose on his jury questionnaire a restraining order and a 2021 domestic-violence charge that was later dismissed. Reddington named the juror in open court for the first time, prompting a tense exchange. "You know, I'm going — I'm going to stop you right there," Sullivan said. "No, you're not going to stop me," Reddington replied. "Well, no, you — I am," the judge answered.

Desronvil's attorneys, Heather O'Connor and Edward Paltzik, rejected the allegations. Paltzik called the defense motions "bananas" and said, "There was a mistrial. It's over; move on, and go prepare for the next trial." The judge had earlier denied a request for an evidentiary hearing about the juror.

Gag Order Request

Prosecutors are also seeking a gag order limiting Reddington's public statements about the case. Defense attorney Laura McConnell called the request premature, and Sullivan took that under advisement as well.

What Happens Next

Clancy is due back in court November 16 for what the judge described as a status or trial assignment conference. Sullivan floated a March trial date; Reddington said he is looking at April. "I want a trial, and I want it with you, and I want it this spring," Reddington told the judge. Sullivan is approaching Massachusetts' mandatory judicial retirement age, a factor adding urgency to the schedule.

Pending before the court are the double jeopardy motion, a request for the juror's records, and the gag order motion. Each ruling could reshape the case. If the double jeopardy motion succeeds, the prosecution would end. If it fails, the defense could appeal, potentially delaying a retrial further.

Why the Case Grips the Country

The Clancy case has become a national flashpoint over postpartum mental illness, the limits of the insanity defense, and the integrity of jury deliberations. For the families touched by the tragedy and for a public still struggling to understand how a mother could harm her children, the uncertainty of another year in court is a heavy burden.
