Inside This Report

  • Judge Alvin Hellerstein set June 1, 2027 as the trial date for Nicolás Maduro and his wife, Cilia Flores.
  • The date came from a joint request by prosecutors and defense, with pretrial motions on sovereign immunity due starting in September.
  • Maduro's legal team plans to argue he cannot be prosecuted because he held head-of-state immunity at the time of his capture.

Nearly seven months after U.S. forces seized him in a nighttime raid on his Caracas compound, former Venezuelan President Nicolás Maduro returned to a Manhattan courtroom Wednesday to receive a trial date that pushes final resolution of his case well into 2027.

U.S. District Judge Alvin Hellerstein of the Southern District of New York set June 1, 2027 as the start of trial for Maduro and his wife, Cilia Flores, on charges tied to an alleged quarter-century conspiracy to traffic cocaine into the United States. The schedule emerged from a joint proposal by prosecutors and the defense, filed a day before the hearing, and reflects the scope of a prosecution that both sides expect to be document- and classified-evidence intensive.

A Brief but Consequential Hearing

Court watchers described Wednesday's proceeding as procedural but significant. The hearing before Judge Hellerstein lasted less than 20 minutes and focused primarily on the timetable for the high-profile narcotics case, which centers on allegations that Maduro and Flores participated in a conspiracy to move cocaine into the U.S. Neither Maduro nor Flores wore restraints and appeared in tan prison uniforms for what marked their third public court appearance since their capture.

Before trial can begin, the court must first work through a contested pretrial phase. The defense is expected to argue that Maduro and Flores cannot be prosecuted because they held sovereign immunity at the time of their detention, and defense attorney Barry Pollack told the court that a favorable ruling on that threshold question could make further litigation over the government's evidence unnecessary.

According to reporting on the schedule, defense attorneys are expected to begin filing motions challenging the indictment in early September, with oral arguments scheduled for November 17. That timeline gives both sides roughly ten months to litigate foundational legal questions before the case would proceed toward trial.

Judge Signals Skepticism on Pace

Despite the agreed-upon date, Hellerstein voiced doubts that the classified-evidence process — a frequent source of delay in national-security-adjacent prosecutions — could be resolved on schedule. Prosecutors and defense attorneys jointly proposed the June trial date but noted the schedule could shift depending on complications such as obtaining classified information, and the judge appeared skeptical the parties would fully resolve those issues before the June trial date, given how lengthy that process can be. Pollack maintained the timeline was workable, calling it realistic and telling the court the defense would flag any developments that might threaten it.

Background: A Case Without Precedent

Maduro and Flores were captured during a January 3 nighttime military raid on their heavily guarded Caracas home, an operation ordered by President Trump. The abduction has been widely characterized by international legal scholars as unlawful, though the administration has defended the operation on the basis that Maduro used his position as head of state to facilitate cocaine trafficking to the U.S. Al Jazeera

Both defendants have pleaded not guilty to charges including drug trafficking and unlawful possession of machine guns, and face potential life sentences if convicted. They have been held in a Brooklyn jail since their transfer to the U.S.

Maduro's defense has already tested one immunity theory and lost — Hellerstein previously rejected an earlier request to dismiss the case on sovereign-immunity grounds — but the defense is expected to press a more developed version of that argument as part of the September motion practice.

With the June 2027 trial date now set and a November 17 hearing on dismissal motions on the calendar, the case enters an extended pretrial phase that will likely determine whether the sovereign-immunity defense gains any traction before a jury is ever seated. Given the judge's own reservations about the classified-discovery timeline, further scheduling adjustments are not out of the question.
