Matthias Bernard, Sofitel GM, Sued in Los Angeles Over Barcelona Watch Robbery of Hotel Guest

A federal-and-state, seven-figure premises-liability action names the Sofitel Barcelona Skipper general manager in his individual capacity — over an alleged pattern of luxury-watch robberies at the hotel's front door, and a décor-first answer that may end up doing a great deal of work in a Los Angeles courtroom.

Matthias Bernard, the general manager of the Sofitel Barcelona Skipper, has been sued personally in the Superior Court of California for the County of Los Angeles over the violent street robbery of one of his own hotel's guests — a case that, on the face of the pleadings, is less about a single stolen Rolex than about what the man in charge of a five-star seafront hotel knew, when he knew it, and what he decided not to tell the people paying to sleep upstairs.

The complaint, filed on June 29, 2026, and logged by the court under transaction number 26LA01386293, names Accor S.A., the Spanish operating entity behind the Barcelona property, Accor Management US Inc., and — in his individual capacity — Matthias Bernard, the hotel's general manager. A parallel complaint has been prepared for the United States District Court for the Central District of California. The plaintiff, an American businessman, is seeking damages of not less than $5 million, together with punitive damages under California Civil Code § 3294. USA Herald

That last detail — the punitive prayer — is not decorative. In California, § 3294 requires clear and convincing evidence of malice, oppression or fraud. Plaintiffs' lawyers do not plead it lightly, and defendants named in their individual capacity, as Matthias Bernard has been, do not sleep through it.

The two seconds that arrived at the Sofitel's front door

The event at the center of the complaint took less than two seconds.

Just after midnight on June 24, 2026, a guest of the Sofitel Barcelona Skipper — a paying customer of the hotel Matthias Bernard runs — was walking back along the Mediterranean boardwalk that fronts the property when, according to court papers, a group of men closed around him, wrenched his arm behind his back, and tore a Rolex Sky-Dweller from his wrist. The watch, valued at roughly $51,400, was gone before he understood it had been taken. So were the men. USA Herald

In another city, in another summer, this would be a police report and a travel-insurance claim. In Barcelona — which by most contemporary rankings sits at the top of Europe's pickpocket capitals, with a per-capita street-crime rate nearly three times the Spanish average — it might have been unremarkable. USA Herald

What is turning it, instead, into a Los Angeles lawsuit is not the theft. It is the answer the guest says he received when he walked back inside.

"It would not match the décor."

The most striking factual allegation in the state-court pleading is a single sentence attributed to the general manager himself.

According to the complaint, when Matthias Bernard was asked why the Sofitel Barcelona Skipper posted no warning of any kind to its guests about the pattern of luxury-watch robberies unfolding at its doorstep, he is alleged to have responded that signage of that kind "would not match the décor." USA Herald

That sentence, if it is established in discovery, will do a great deal of work.

In premises-liability law, the cost of a warning sign is the canonical, textbook example of a precaution so cheap that a jury is ordinarily entitled to demand it. Under the controlling California authority, Delgado v. Trax Bar & Grill, 36 Cal. 4th 224 (2005), a business proprietor's duty to protect patrons from third-party criminal conduct scales with the foreseeability of harm — measured against the burden of the precaution the plaintiff says was required. Where the harm is highly foreseeable and the fix is a printed notice at the front desk, the burden argument tends to collapse.

Foreseeability, in this case, is not a lawyer's speculation. It is, per the complaint, hotel dinner-table conversation.

What the assistant manager is alleged to have said

The pleadings do not leave the general manager's décor line hanging in mid-air. They surround it.

The state-court complaint alleges that within the same three-day window in which the guest was robbed, at least four other guests of the Sofitel Barcelona Skipper were stripped of luxury watches — including a Patek Philippe. It further alleges that an assistant manager at the hotel, identified in the pleading as Olga Incagnoli, told the guest, in substance, that guests of the property were being robbed "at least once a week," and that hundreds of similar incidents had been reported in the immediate vicinity over a period of years. USA Herald

Read together, those allegations tell a story a jury will find easy to follow: not a single, unforeseeable street crime, but a running weekly toll, known inside the building, disclosed to no one outside it.

The doctrine at the door

The legal question the complaint puts to a Los Angeles jury is older than the Sofitel, older than Accor, and older than Barcelona's modern tourist economy. It is the question of what an innkeeper owes a guest who walks out the front door.

American common law has for more than a century treated the hotel-and-guest relationship as a "special relationship" — one that imposes affirmative duties beyond those an ordinary landowner owes an ordinary visitor. Warn of known dangers. Take reasonable steps against foreseeable third-party criminal conduct. Do not turn the front lobby into a trap decorated by a general manager who thinks a printed notice at the concierge desk clashes with the wallpaper.

Against that doctrinal backdrop, the complaint pleads causes of action for negligence, premises liability, negligent failure to warn, negligent infliction of emotional distress, and — in the state-court version — fraudulent concealment, seeking damages of not less than $5 million plus punitive damages under § 3294. USA Herald

Fraudulent concealment, as any Los Angeles defense partner will confirm at 2 a.m., is the count that keeps general managers awake. It is the count that says: you knew, and you did not tell. It is also the count most likely, if it survives demurrer, to give the plaintiff a runway into the punitive-damages prayer.

Why Bernard, personally

There will be a temptation, in Accor's Paris headquarters and in Sofitel's Barcelona back office, to treat the naming of Matthias Bernard in his individual capacity as procedural theater. That would be a mistake.

Individual-capacity claims against hotel general managers are unusual precisely because they are not casual. In California, they typically survive early motion practice only when the pleading identifies specific acts or omissions of the individual defendant — not the entity — that meet the elements of the torts alleged. The complaint here does exactly that: it puts Bernard's own alleged words in his own alleged mouth, links those words to the absence of a warning, and links the absence of a warning to a robbery that his own assistant manager is said to have described as a weekly occurrence.

That is the shape of an individual-capacity claim built to survive.

It is also the shape of a case in which the general manager's deposition will not be a supporting appearance. It will be the main event.

The court has confirmed receipt of the filing. The federal parallel is drafted. Discovery, when it opens, will move quickly toward two categories of documents: the hotel's own internal incident logs for luxury-watch thefts involving Sofitel Barcelona Skipper guests, and every internal communication — email, WhatsApp, memo — in which the words warningsignagesign, or notice appear next to the name Matthias Bernard.

The Sofitel Barcelona Skipper has, to date, offered no public response to the individual-capacity claims against its general manager. Accor S.A. has issued no statement on the pleadings.

The décor, in the end, may prove expensive.
