Milwaukee Judge Arrested for Aiding Suspect’s Escape Sparks National Scrutiny of Judicial Bias on Immigration

(Milwaukee, WI) — On Friday morning the FBI arrested Milwaukee County Circuit Court Judge Hannah Dugan, charging her with criminal obstruction and harboring an illegal immigrant wanted by ICE.

Dugan was taken into custody by the FBI on Friday morning on the courthouse grounds, according to U.S. Marshals Service spokesperson Brady McCarron. She appeared briefly in federal court in Milwaukee several hours laters before being released from custody. She faces charges of “concealing an individual to prevent his discovery and arrest” and obstructing or impeding a proceeding.

“Judge Dugan wholeheartedly regrets and protests her arrest. It was not made in the interest of public safety,” her attorney, Craig Mastantuono, said during the hearing.

According to the criminal complaint, Dugan was alerted to the presence of U.S. Immigration and Customs Enforcement agents in the courthouse by her clerk, who was informed by an attorney that they appeared to be in the hallway.

Dugan, elected in 2016, now faces serious federal charges, two in particular: violating 18 U.S.C. §1505 (Obstruction of Proceedings Before Departments or Agencies) and 18 U.S.C. §1071 (Concealing a Person to Prevent Arrest) — offenses that carry potential prison terms of up to five years each.

According to the FBI affidavit filed April 24, 2025, Dugan allegedly used her authority to personally escort Eduardo Flores-Ruiz — an illegal immigrant facing domestic violence charges — out a jury door normally restricted to staff and escorted inmates. Dugan was "visibly angry" when alerted to ICE’s presence and chose to subvert lawful proceedings by secretly aiding Flores-Ruiz's escape.

After directing the arrest team to the chief judge’s office, investigators say, Dugan returned to the courtroom and was heard saying words to the effect of “wait, come with me” before ushering Flores-Ruiz and his lawyer through the jury backdoor into a non-public area of the courthouse.

The action was unusual, the affidavit says, because “only deputies, juries, court staff, and in-custody defendants being escorted by deputies used the back jury door. Defense attorneys and defendants who were not in custody never used the jury door.”

ICE agents, already stationed in the courthouse hallways with an administrative warrant in hand, were blindsided by the judge's actions. The affidavit notes that rather than allow the arrest to occur in a controlled environment, Dugan forced a risky foot pursuit across downtown Milwaukee — putting law enforcement officers and civilians in harm's way.

As of late Friday afternoon, there remains a posted sign on Dugan’s courtroom door advised that if any attorney or other court official “knows or believes that a person feels unsafe coming to the courthouse to courtroom 615,” they should notify the clerk and request an appearance via Zoom.

A Pattern Emerges: Judge Dugan, Judge Cano, and Judicial Activism

The Dugan scandal follows close on the heels of former New Mexico Judge Joel Cano’s arrest, alongside his wife, Nancy Cano for allegedly harboring a violent Tren de Aragua gang member inside their home. (Read USA Herald’s coverage of the Cano arrest here).

Taken together, these arrests highlight growing concerns that certain judges — particularly in liberal or "sanctuary" jurisdictions — are illegally inserting their personal political views into the judicial process, endangering public safety and violating their constitutional oaths.

Judge Dugan is charged under:

  • 18 U.S.C. §1505: Makes it a federal crime to corruptly obstruct or impede the due administration of law under any department or agency of the United States.
  • 18 U.S.C. §1071: Criminalizes concealing or harboring any person to prevent their arrest.

By allegedly aiding Flores-Ruiz, Dugan directly obstructed ICE’s execution of a valid administrative warrant — an act that federal prosecutors deem a direct affront to immigration enforcement efforts, and national security.

The FBI affidavit describes how Dugan, upon learning of ICE’s presence, “left the bench” in anger, conspired with another judge to divert ICE agents to the Chief Judge’s office, and then secretly ushered the defendant and his attorney through restricted courthouse areas.

The gravity here is multifold: not only was a dangerous defendant temporarily able to evade custody, but the trust placed in the judiciary to act impartially and uphold the law has been deeply shaken.

The Department of Justice's memo from January 2025 explicitly ordered prosecutors to pursue charges against any state or local officials impeding federal law.

Dugan’s arrest may signal a turning point.
