In a move that underscores the collision between global ambition and local policy, Namibia blocks Elon Musk's Starlink, denying the satellite internet provider a license to operate and dealing it another blow in southern Africa.

The decision was announced by the Communications Regulatory Authority of Namibia, which declined to grant approval to Starlink, a company owned by Elon Musk.

Ownership Rules at the Center of Rejection

While the regulator did not provide detailed reasoning, it pointed to a critical issue: Starlink’s Namibian subsidiary lacks local ownership.

Under Namibian law, at least 51% of any telecommunications company must be owned by citizens or domestic entities—a requirement rooted in efforts to rebalance economic participation after decades of inequality.

The decision reflects a broader principle: in Namibia, access to markets must align with national ownership priorities.

Starlink Faces Regional Regulatory Hurdles

Starlink, which operates in roughly 25 African countries, has encountered similar barriers elsewhere in the region.

In South Africa, regulatory requirements tied to ownership have also prevented the company from launching services, highlighting a recurring friction between global tech expansion and local compliance frameworks.

The company has yet to publicly respond to Namibia’s latest decision.

A Legal Framework Shaped by History

Namibia’s policies are deeply intertwined with its past. Once a German colony and later governed under South Africa’s white-minority rule, the country gained independence in 1990 and introduced laws aimed at correcting historical inequalities.

These include mandates to boost local ownership and participation in key industries—policies that continue to shape investment decisions today.

Potential for Reconsideration Remains

Despite the rejection, the door is not fully closed. The regulator said it could revisit the decision within 90 days, either independently or in response to a formal appeal.

Starlink has indicated on its website that it established a local entity intended to partner with Namibian firms and create jobs, suggesting it may seek to align more closely with regulatory expectations.

Previous Clashes and Broader Debate

This is not the first clash between Starlink and Namibian authorities. In 2024, the regulator ordered the company to cease operations, accusing it of providing services without a license and warning the public that using its equipment would be illegal.

Meanwhile, Musk has openly criticized similar policies in South Africa, calling them “racist ownership laws.” In a post on X, he claimed his company was barred from operating there due to racial requirements.

South African officials rejected that assertion, stating that Starlink is welcome to operate if it complies with local regulations. They noted that hundreds of foreign firms, including Microsoft, are successfully doing business under those same rules.

Starlink’s satellite network is designed to deliver high-speed internet to remote and underserved areas—regions where traditional infrastructure struggles to reach.
