A Nebraska tribe’s tobacco companies are petitioning the U.S. Supreme Court to overturn a ruling by the Eighth Circuit, which upheld Nebraska's ability to regulate tobacco sales by a tribally owned manufacturer to Indigenous-owned distributors. The Winnebago Tribe of Nebraska argues that the case raises crucial questions about tribal sovereignty and the right of Native American nations to manage their own economic affairs within their borders, free from state interference.

In their petition, HCI Distribution and Rock River Manufacturing, tribal entities, argue that a tribe’s ability to run its businesses and manage economic development without state regulation is fundamental to its sovereignty. The companies contend that this case goes to the heart of tribal self-governance, asserting that a tribe’s interest in managing its business operations should not be contingent on the size or profitability of the business.

The legal battle began in 2018 when the Winnebago Tribe sued Nebraska’s state attorney general and tax commissioner, accusing them of colluding with Big Tobacco to undermine the tribe’s sovereignty. The dispute centers around the 1998 Tobacco Master Settlement Agreement (MSA), which imposed specific requirements on tobacco manufacturers and allocated a portion of their revenues to state-held escrow funds for healthcare-related costs. The tribe, however, argues that they had entered into their own separate agreement with tobacco companies in 2016 and that Nebraska’s regulations violate the Indian Commerce Clause of the U.S. Constitution.

A partial victory for the tribe came in April 2023 when a federal district court ruled that the state could not collect revenue from tobacco sales made on the Winnebago Reservation. However, the state was allowed to continue regulating sales outside the tribe’s land. This decision was mostly overturned by the Eighth Circuit in August, which ruled that Nebraska can regulate tobacco sales made to nonmembers on the reservation, even if all transactions occur within tribal boundaries.

The tobacco companies argue that this ruling conflicts with Supreme Court precedents such as California v. Cabazon Band of Mission Indians (1987), which affirmed that states cannot regulate tribal activities that are not in conflict with federal law. They further contend that the Eighth Circuit wrongly applied the Bracker balancing test without establishing the “exceptional circumstances” required for state intervention in tribal affairs, as outlined in the 1983 ruling New Mexico v. Mescalero Apache Tribe.

The petition also criticizes the Eighth Circuit’s ruling for creating practical issues, including how a manufacturer could determine whether a customer is a tribal member or nonmember. The companies argue that such regulations would be burdensome and would stifle the tribe's ability to manage its businesses effectively.

The case has broader implications for tribal economic development. The Winnebago Tribe argues that state regulations aimed at strangling tribal businesses early in their development could cripple efforts to achieve economic self-sufficiency, with the state using weakened businesses as a rationale for further regulation.

The petition to the U.S. Supreme Court has garnered attention for raising important questions about tribal sovereignty and state powers. The outcome of this case could set a significant precedent for Native American nations' rights to regulate their own economic affairs without state interference.

The case, HCI Distribution Inc. et al. v. Mike Hilgers et al., is currently before the U.S. Supreme Court under case number 24-615. The Winnebago Tribe is represented by Calandra S.
