Sometimes the smallest details carry the biggest legal weight — and few things get smaller than a single stylized letter. Nitra Inc., an artificial intelligence-native all-in-one platform providing fintech-related services to help healthcare practices save time and money, has accused a rival company of impermissibly adopting a "strikingly and confusingly similar" design mark for the letter "N," according to a trademark infringement action filed Friday in California federal court.

The Allegations at the Center of the Complaint

In a 27-page complaint, Nitra accused San Mateo, California-based Zealth Inc. — which operates under the name Notable Health — of violating both state and federal trademark laws by adopting a confusingly similar trademark after Nitra had already established its own use. According to the suit, Nitra has continuously used its "N" design mark since February 2023, while Zealth allegedly adopted its own version of the infringing mark in March 2024 — more than a year after Nitra's claimed first use.

Two Companies, Strikingly Similar Territory

Zealth describes itself as an intelligent healthcare automation and AI platform founded in 2017, according to the suit. But the overlap between the two companies, Nitra argues, extends well beyond just a similar logo. "Both Nitra and Zealth offer similar goods and services under their respective and confusingly similar marks, including at least software-as-a-service and AI software for healthcare providers that automate administrative and operational functions," the complaint states.

A Long List of Shared Services

According to Nitra, the overlapping services between the two companies span patient scheduling, practice access, health insurance verification, prior authorizations, AI-powered communications, workflow automation, revenue-related processes and practice management. The similarities extend even further into AI systems, voice agents and conversational software designed to communicate directly with patients on behalf of healthcare providers — essentially painting a picture of two companies operating in nearly identical technological terrain.

A Shared Mission, A Shared Customer Base

Under their competing trademarks, both companies work to automate administrative healthcare workflows, integrate with existing healthcare systems, deploy AI agents for operational tasks, reduce manual labor, improve patient access, automate insurance processes, streamline scheduling and booking, and support financial operations — a laundry list of functional overlap that Nitra argues goes well beyond coincidence.

Targeting the Same Healthcare Providers

The suit further alleges that Nitra and Zealth pursue the same customer base, offering their respective services and AI systems to physician practices, medical groups, clinics, ambulatory providers and other provider organizations across the healthcare industry.

Accusations of Deliberate Copying

Nitra's complaint goes beyond simply alleging similarity — it accuses Zealth of intentional infringement. "On information and belief, Zealth adopted Zealth's infringing mark after becoming aware of Nitra, the Nitra design mark, and the goods and services offered by Nitra," the complaint alleges. "Thus, on information and belief, Zealth's infringement was knowing and willful. For example, Zealth deliberately avoided applying to register the 'stylized N' alone because it knew about the Nitra design mark and wanted to avoid an office-action rejection."

Establishing Nitra's Prior Claim

Nitra maintains it has continuously used the "Nitra" word mark, the stylized "N" design mark, and combinations of the two since as early as February 2023. The company says it holds a trademark registration for the "Nitra" word mark, along with a separate registration for the "N" design mark that was granted in November 2024.

Zealth's Own Trademark History

According to the suit, Zealth operates under the "Notable" name and mark, which it launched in April 2017 to provide voice-powered healthcare services. As early as 2018, Zealth's own website reportedly touted its use of cutting-edge deep learning to identify voices, content and intents, aiming to make every patient visit a "remarkable experience," the complaint notes.

A Platform That Grew Into Nitra's Territory

By February 2023, Zealth was marketing its ability to help healthcare clients serve more patients without hiring additional staff, while digitizing patient intake, scheduling, authorizations and more through what it called a platform for intelligent automation — functionality that, according to Nitra, increasingly mirrored its own offerings.

The Trademark Filing at the Heart of the Dispute

On March 21, 2024, Zealth filed an application with the U.S. Patent and Trademark Office for what it described as a stylized letter "N" positioned next to the word "Notable," according to the suit. That mark was ultimately registered in April 2025, covering software-as-a-service offerings for personalized health and wellness recommendations, along with platform-as-a-service capabilities for managing medical practices, clinical support, insurance verification, payment processes, patient monitoring, referrals and more, Nitra alleges. Zealth claimed a first-use date of Feb. 26, 2024, for the mark.

A Visual Comparison Nitra Wants the Court to See

Nitra argues that if the court examines both companies' websites directly, the visual similarity becomes immediately apparent — both Zealth and Nitra prominently feature "N" logos in connection with their respective healthcare-related services and offerings.

What Nitra Is Asking the Court to Do

Nitra's complaint asserts several causes of action against Zealth, including trademark infringement and false designation of origin under the federal Lanham Act, trademark infringement under California law, unfair competition under California law, and cancellation of a trademark registration under federal law.

The Remedies Nitra Is Seeking

Nitra is asking the court to find that Zealth has violated the laws outlined in its complaint and to permanently block the company from marketing, distributing or selling any products or services under the allegedly infringing "N" mark, or any colorable imitations of Nitra's design mark. The plaintiff is also seeking cancellation of Zealth's U.S. trademark registration covering the combination of the "N" letter mark with the "Notable" name, along with damages, attorney fees and costs.

Where the Case Stands Now

Representatives for the parties did not immediately respond to inquiries seeking comment Monday.
