A Pennsylvania judge has slapped Offit Kurman Attorneys At Law with a hefty $4 million penalty, ruling that the firm's handling of a client's case was severely lacking and directly led to a substantial financial judgment. The decision, handed down by Philadelphia Court of Common Pleas Judge Abbe Fletman on Tuesday, underscores serious lapses in legal care and diligence.

Offit Kurman $4M Fine : Judge's Ruling Details

In her ruling, Judge Fletman decreed that Offit Kurman must pay $2.8 million for claims of legal malpractice and breach of contract, along with nearly $1.2 million in accrued interest and fees dating back to 2017. The lawsuit, brought by Mitts Law LLC on behalf of Sainty Renewable Energy Investment Holdings Inc., alleged that Offit Kurman’s negligence resulted in a $3 million judgment against their client.

The case against Offit Kurman stemmed from its representation of Corey Wolff, who was sued by Sainty for breach of contract related to a solar energy installation project. Wolff had originally hired Offit Kurman’s Kevin Watson in 2017 after his previous lawyer exited the case. According to Mitts Law, Watson's failure to adhere to discovery orders and to timely appeal the default judgment led to the substantial financial penalty.

Judge Fletman described Offit Kurman’s legal services as falling well below the standard of care expected from attorneys. The firm was criticized for its inadequate investigation into the status of the case, failure to respond to discovery requests, and delays in appealing the default judgment. Additionally, Judge Fletman found that Offit Kurman breached its contractual obligations to Wolff by neglecting to act on court orders and opposing motions.

Rejection of Contributor Negligence Claim

Offit Kurman’s defense that Wolff was contributorily negligent was dismissed by Judge Fletman. The judge emphasized that clients should not be held responsible for anticipating their attorney’s negligence, reinforcing the expectation that lawyers will perform their duties with reasonable care.

Reactions and Future Steps

Maurice Mitts of Mitts Law praised the ruling, asserting that it restores integrity to the legal process and ensures that Sainty's losses are addressed. He criticized Offit Kurman's non-compliance, suggesting that the resolution could have been reached sooner had the firm adhered to legal standards.
