In a verdict that echoes like a thunderclap across workplace policies and maternal care, an ohio family $22.5M award has been handed down after jurors concluded a corporate decision set off a tragic chain of events ending in the death of a newborn.

High-Risk Pregnancy at Center of Lawsuit

The case revolves around Chelsea Walsh, a claims associate at Total Quality Logistics in Cincinnati, who sought permission to work remotely during a high-risk pregnancy following a medical procedure.

According to court filings, Walsh’s request was denied — leaving her with an impossible choice: return to the office or take unpaid leave, forfeiting both income and health insurance.

Nine days before she went into labor, Walsh formally asked for accommodation. Instead, the lawsuit claims, the company issued leave-of-absence paperwork rather than the appropriate accommodation forms, effectively categorizing her as unable to work.

A Race Against Time Ends in Tragedy

Despite medical advice urging her to stay home, Walsh reported to the office for three consecutive days. Then, on the evening of Feb. 24, 2021, her condition deteriorated.

Later that night, she was hospitalized after experiencing complications. At nearly 21 weeks pregnant, she gave birth to her daughter, Magnolia.

According to the lawsuit, the infant showed signs of life — a heartbeat, breathing, and movement — before being placed on her mother’s chest. Roughly 90 minutes later, Magnolia died.

In a cruel twist, the company reversed its stance and approved remote work only hours before Walsh went into labor, following intervention by a third party.

Jury Assigns Blame, Delivers $22.5M Judgment

Jurors found that Total Quality Logistics’s refusal to grant a work-from-home accommodation directly contributed to the infant’s death.

The jury initially awarded $25 million in damages, assigning 90% of the fault to the company — resulting in an ohio family $22.5M award.

Attorney Matthew C. Metzger, co-counsel for the family, said the evidence painted a clear picture.

“The jury found that denying a reasonable request during a high-risk pregnancy led to the death of her daughter,” Metzger said, calling the outcome “heartbreaking.”

Company Pushes Back on Verdict

In response, a spokesperson for Total Quality Logistics expressed sympathy but rejected the jury’s conclusions.

“We extend our condolences to the Walsh family,” said Julia Daugherty. “We disagree with the verdict and the way the facts were characterized at trial.”

The company said it is reviewing its legal options while reaffirming its commitment to employee well-being.
