Perez Hilton’s Mother Seeks Temporary Custody of His 3-Kids After Livestream Crisis—What Florida Courts Will Now Examine

Perez Hilton’s family has moved from crisis response to child protection.

Days after the celebrity blogger was hospitalized following a disturbing TikTok livestream from his Miami-area home, his mother, Teresita Lavandeira, filed a petition seeking temporary custody of his three children, according to reports citing court records.

The petition is not a final custody ruling. But it places the children’s immediate stability, safety, and emotional welfare before a court at a moment when their father faces what his family has described as a long recovery.

Hilton—whose legal name is Mario Armando Lavandeira Jr.—is the single father of Mario III, 13, Mia Alma, 11, and Mayte, 8. His family has said the children, along with Hilton’s sister and niece, were at the home shortly before the incident. Once relatives recognized that he was in a severe mental-health crisis, they reportedly left with the children, according to the family’s public statement. 

That sequence matters. The legal question is no longer only whether Hilton receives medical and psychiatric care. It is whether the children need a court-supervised arrangement while he is unable to resume parenting safely and consistently.

Reports indicate that Hilton’s mother filed for temporary custody on August 7, and that the petition’s stated purpose is to protect the children and provide stability during their recovery. Forbes reported that Hilton consented to the temporary arrangement, according to documents reviewed by Page Six. No final ruling or final long-term parenting plan has been publicly confirmed.

That distinction is critical. A petition is a request—not an automatic grant—and a grandparent or aunt does not receive legal authority merely because of family status. Florida guardianship proceedings are court-supervised. Prospective guardians must submit an application describing their qualifications, and Florida law generally requires a credit-history investigation and Level 2 background screening unless the court waives those requirements. The judge must consider those results before appointment. Fla. Stat. §§ 744.3125 and 744.3135

A court can therefore examine far more than goodwill and blood relation. It may assess who can provide a stable home, supervise school and medical needs, manage the children’s emotional care, maintain safe boundaries, and protect them from further exposure to an unstable or traumatic environment. It may also consider whether proposed caregivers have the practical ability to keep the children insulated from media pressure, online exploitation, and household conflict.

If child-welfare authorities opened a separate inquiry, that would be a different track from a probate or guardianship petition. The public reporting reviewed by USA Herald does not establish that a dependency case has been filed. But a child-protection investigation, if one exists, could independently evaluate safety conditions and placement options.

The most immediate legal reality is equally important: temporary custody is not a casual arrangement under which caregivers simply return the children whenever Hilton leaves the hospital. If a court grants temporary authority, it controls unless and until the court modifies it. Any later return of parental responsibility—or any contact between Hilton and the children—would be governed by the terms of the order, the evidence then available, and the children’s best interests.

That does not mean a court will necessarily impose no contact or supervised visitation. No publicly confirmed order establishing either condition has been identified. But courts routinely have tools to structure contact where safety, emotional stability, or reunification readiness remains unresolved. Those tools can range from supervised contact and therapeutic conditions to gradual reunification plans. The specifics depend on evidence, professional assessments, and judicial findings.

The children’s experience will likely be central. Their family has said its “highest priority” is helping them heal and asked media, photographers, and content creators to stay away from the residence. Entertainment Weekly reported that the family described Hilton’s recovery as a long process following significant blood loss and injuries requiring surgery.

This is, first and foremost, a child-welfare story— The central question for the legal system is direct: who can safely provide these children consistency, protection, and room to recover while their father receives care?
