‘Shark Tank’ Chef Sues Wells Fargo Over Alleged Racial Bias At Nevada Branch Involving A Treasury Check

HENDERSON, NV - Shawn “Chef Big Shake” Davis has filed a civil action in Clark County District Court alleging a Henderson Wells Fargo branch wrongly branded his $20,400 U.S. Treasury check as fraudulent and denied him routine business banking services. The complaint names Wells Fargo Bank and business adviser David Parra at the 2531 Anthem Village Drive branch and asserts racial discrimination, defamation, negligence, and intentional infliction of emotional distress.

Davis says he appeared for a scheduled July 11 account-opening appointment, provided identification and documentation, watched the banker step away for about fifteen minutes, and then was told his Treasury check was fake. He characterizes the accusation as abrupt, unsupported, and tinged with the assumption that he could not legitimately receive such a payment because he is Black.

Davis, a Florida restaurateur known for hot chicken and shrimp burgers and a “Shark Tank” appearance, alleges that the treatment in Nevada was not a good-faith verification mistake but a denial of service tied to race. After returning home to Tampa, he says another Wells Fargo branch opened the business account and deposited the same Treasury check without incident, with staff confirming there is no direct line to the IRS for such inquiries and noting that the Nevada branch failed to create an account, enter internal notes, or complete legitimate work during the forty-five minute visit. His attorney, Milan Chatterjee, frames the case as an effort to spotlight what he describes as routine prejudice faced by African Americans in corporate settings. The suit seeks damages above Nevada’s jurisdictional minimum and reserves the right to pursue punitive and reputational harms as discovery develops.

From a legal-process standpoint, this is an early-stage complaint and no facts have been adjudicated. Expect threshold maneuvering that could include removal to federal court, given the likely presence of federal civil-rights claims under 42 U.S.C. §1981 alongside state-law torts. Section 1981 protects the right to make and enforce contracts free from racial discrimination; in banking, denying or degrading standard account-opening or deposit services can implicate that contractual right.

The plaintiff bears the initial burden to show intentional discrimination; the bank may respond with a legitimate, non-discriminatory reason such as documented fraud-risk triggers or policy constraints; the ultimate burden returns to the plaintiff to prove pretext by a preponderance of the evidence.

The defamation claim focuses on the reputational sting of accusing a customer of attempting to pass a fraudulent check, which can constitute defamation per se if published to third parties in a business setting, though banks often assert qualified privileges for internal investigations. Negligence will turn on whether staff deviated from reasonable verification procedures for Treasury instruments and whether communications were handled with due care. Intentional infliction of emotional distress requires extreme and outrageous conduct causing severe distress, a standard courts apply sparingly; many such claims rise or fall on facts developed in internal emails, teller logs, branch messaging tools, and comparator data showing how similarly situated customers were treated.

The immediate practical questions are straightforward and evidence-driven. What, if anything, did the branch’s systems flag about the check or the customer profile. Did personnel follow written procedures for Treasury-check verification and account onboarding. Were statements about fraud or IRS verification conveyed beyond necessary internal channels. Are there contemporaneous notes or video showing neutral application of policy, or do internal records corroborate plaintiff’s account of a baseless accusation followed by inaction. Those materials, along with testimony from the Tampa branch that later processed the deposit, are likely to define the trajectory of the case more than rhetoric from either side.
