Standing Rock Reopens Dakota Access Pipeline War With New Federal Lawsuit Seeking Shutdown

What’s at Stake Beneath Lake Oahe

  • Standing Rock is asking a federal court to overturn the Army Corps’ newly issued easement allowing Dakota Access to cross beneath Lake Oahe.
  • The Tribe says federal regulators still have not adequately addressed spill response, pipeline capacity, drinking-water risks and treaty rights.
  • A shutdown is not automatic, but victory could strip away the federal approvals supporting continued operation at one of the pipeline’s most contested crossings.

One of America’s longest-running pipeline fights is back in federal court.

The Standing Rock Sioux Tribe has filed a new lawsuit challenging the federal government’s approval of the Dakota Access Pipeline crossing beneath Lake Oahe — reopening a legal battle that helped trigger massive protests, arrests and a national debate over tribal sovereignty nearly a decade ago.

The case, Standing Rock Sioux Tribe v. Army Corps of Engineers, No. 1:26-cv-03540, was filed in the U.S. District Court for the District of Columbia. The defendants include the U.S. Army Corps of Engineers, the Pipeline and Hazardous Materials Safety Administration and federal officials from both agencies.

At the center of the dispute is the Corps’ May 21, 2026 Record of Decision granting Dakota Access LLC a new easement for the pipeline to cross federal property beneath Lake Oahe in North Dakota.

That decision followed years of environmental review after an earlier easement was vacated during prior litigation. The Corps selected what it calls Alternative 4, allowing the pipeline crossing to remain while imposing additional conditions.

Standing Rock says that still isn’t good enough.

According to the Tribe, the Final Environmental Impact Statement fails to adequately address pipeline safety, emergency spill response, threats to Lake Oahe — the Tribe’s drinking-water source — and federal obligations arising from treaty rights. The lawsuit also targets federal approvals involving oil-spill response plans.

There is another issue that deserves attention: capacity.

The federal environmental review examined operations at potentially as much as 1.1 million barrels per day, although North Dakota Pipeline Authority Director Justin Kringstad has said the pipeline’s current operational capacity is approximately 750,000 barrels per day and recent average throughput has been substantially lower.

Standing Rock argues that higher potential throughput changes the risk calculation. More oil moving through the system can affect the possible volume of a spill, emergency shutdown considerations and the consequences if containment measures fail near the Missouri River.

Pipeline supporters see the case very differently. Energy and industry advocates maintain Dakota Access has safely transported crude since 2017 and note that the pipeline is buried deeply beneath the Lake Oahe riverbed. They argue the Corps spent years studying the crossing before issuing its new approval.

The important legal question, however, is not simply whether supporters believe the pipeline is safe.

The court will be asked to determine whether federal agencies followed governing law when making their decisions — including whether the administrative record adequately supports those decisions and whether the government properly considered the risks and legal interests Standing Rock says were ignored.

Standing Rock has not obtained an order shutting down Dakota Access merely by filing the case. The pipeline continues operating. But the Tribe is seeking relief that could invalidate the Lake Oahe easement, overturn federal spill-response approvals and prevent oil from moving through the disputed crossing unless federal requirements are satisfied.

It is another chapter in litigation dating back to the original Dakota Access fight of 2016 and 2017. In 2020, a federal court found serious problems with the Corps’ earlier environmental review, and the D.C. Circuit later affirmed the vacatur of the original easement. The review that followed eventually produced the December 2025 Final Environmental Impact Statement and the May 2026 approval now being challenged.

A decade later, the argument has returned to nearly the same stretch of water.

This time, however, Standing Rock is challenging a federal government that has completed the full environmental-impact process the earlier litigation demanded. That makes the coming fight different — and potentially harder. The Tribe must now persuade the court that the completed review and resulting agency decisions themselves are legally defective.

The spill-response plan seems central here. Has the Tribe been given enough detail to evaluate how its drinking water would be protected in an emergency?
