Supreme Court Questions Police Power to Track People Through Cellphones

The Supreme Court on Monday appeared deeply divided over how far police can go in using cellphone data to track Americans, in a case that could reshape digital privacy in the United States. During oral arguments in Chatrie v. United States, justices wrestled with whether law enforcement should have broad access to location data or face strict constitutional limits that require a warrant.

What unfolded in the courtroom suggested a Court trying to balance modern policing tools against the risks of unchecked surveillance in an era where nearly every movement can be traced through a phone.

A Case That Tests Digital Privacy Boundaries

At the center of the dispute is whether police can use cellphone data to determine who was near the scene of a crime. The case stems from the conviction of a man accused of robbing a bank, and it raises urgent questions about how far constitutional protections extend in the digital age.

If only the first half of the argument was considered, the Court appeared poised to significantly narrow Americans’ privacy rights. The justices’ early questioning of defense attorney Adam Unikowsky, who represents the convicted defendant, suggested skepticism toward claims that the Constitution imposes strict limits on government cellphone tracking.

Some justices even appeared open to scaling back Carpenter v. United States (2018), a landmark ruling that requires police to obtain a warrant before accessing historical cellphone location data.

Concerns Shift as Government Takes the Floor

However, the tone shifted when Justice Department attorney Eric Feigin began presenting the government’s case. As the argument progressed, several justices voiced growing concern about how far the government’s interpretation could extend.

Chief Justice John Roberts warned early in Feigin’s argument that overly broad surveillance powers could allow authorities to identify attendees at religious services or political gatherings simply by analyzing cellphone data.

Other justices raised additional alarms, questioning whether the government’s position could eventually allow warrantless access to sensitive personal information such as emails, calendars, and photos.

The concerns reflected a broader unease on the bench about the real world consequences of expansive digital surveillance powers in the hands of law enforcement.

A Narrow but Significant Decision Expected

Despite the tension, the Court appears headed toward a restrained ruling. Based on the questioning, justices seem inclined to interpret Carpenter in a way that reinforces the need for warrants before police attempt to track individuals through cellphone data.

At the same time, the facts of the case may limit the scope of the ruling. Police in Chatrie did obtain a warrant, and the Court may ultimately find that the warrant satisfied constitutional requirements.

That outcome would make Chatrie v. United States a narrow decision. It would likely preserve existing privacy protections recognized in prior rulings while stopping short of expanding them further in response to rapidly evolving surveillance technology.

For now, the case underscores a growing legal and societal tension: how to apply decades-old constitutional principles to a world where personal data is constantly generated, collected, and potentially exposed.
