‘Take It Down Act’ Targets Deepfakes and Revenge Porn With Tough New Rules

Take It Down Act

The Take It Down Act is bipartisan legislation headed to President Trump’s desk. It is meant to address the growing concern over AI-generated and non-consensual images.

Overview of the ‘Take It Down Act’

In a significant move to address the rising threat of non-consensual intimate imagery and AI-generated "deepfakes," Congress has passed the Take It Down Act, a bipartisan bill that now awaits President Donald Trump’s signature.

The bill, supported across party lines, is a landmark step toward protecting victims of digital abuse and strengthening federal oversight of online platforms.

The new law makes it illegal to “knowingly publish” or threaten to publish intimate images without consent, including computer-generated deepfakes.

It also requires websites and social media platforms to remove the content within 48 hours of receiving notice from a victim and take action to prevent duplicate content from resurfacing.

“These images can ruin lives and reputations,” said Sen. Amy Klobuchar, one of the bill's sponsors. “But now that our bipartisan legislation is becoming law, victims will be able to have this material removed from social media platforms and law enforcement can hold perpetrators accountable."

Why the Take It Down Act Matters

While many states have enacted laws against revenge porn or AI-generated intimate imagery, the Take It Down Act marks a rare instance of federal regulation targeting internet content. The urgency of such legislation has grown as deepfake technology has become increasingly accessible and realistic.

The bill was co-sponsored by Sen. Ted Cruz (R-TX) and Sen. Amy Klobuchar (D-MN). 

The bill also received strong support from First Lady Melania Trump, who said it was “heartbreaking” to see what young people—particularly girls—go through when targeted by such content.

The legislation was partially inspired by the story of Elliston Berry, a 14-year-old whose mother contacted Sen. Cruz after Snapchat allegedly refused to take down a deepfake image of her daughter for nearly a year.

Big Tech Response: Meta and Industry Backing

Meta, the parent company of Facebook and Instagram, has backed the Take It Down Act.

“Having an intimate image – real or AI-generated – shared without consent can be devastating,” said Meta spokesman Andy Stone. “Meta developed and backs many efforts to help prevent it.”

The Information Technology and Innovation Foundation, a tech industry-supported think tank, also applauded the bill’s passage, calling it “an important step forward that will help people pursue justice” when victimized by non-consensual intimate imagery.

Censorship and Free Speech Concerns

Despite broad support, the Take It Down Act has drawn criticism from free speech advocates, including the Electronic Frontier Foundation (EFF) and the Cyber Civil Rights Initiative, who argue the bill's language is overly broad and could violate First Amendment protections.

“While the bill is meant to address a serious problem, good intentions alone are not enough to make good policy,” said the EFF in a statement. “Lawmakers should be strengthening and enforcing existing legal protections for victims, rather than inventing new takedown regimes that are ripe for abuse.”

The EFF highlighted that the 48-hour removal window may not be enough time for platforms to verify the legality of the reported content, potentially leading to hasty censorship. They also raised alarms that the law could compel platforms to monitor encrypted or private content to avoid liability.

The Cyber Civil Rights Initiative echoed these concerns, calling the bill “unconstitutionally vague and overbroad”. The group warned that platforms might be forced to take down legitimate content—such as news coverage of public protests or law enforcement alerts—if falsely flagged as non-consensual.

What Happens Next

With the bill now on President Trump’s desk, it is widely expected that he will sign it into law, especially given the high-profile backing from First Lady Melania Trump and bipartisan Congressional support. Once enacted, the Take It Down Act will establish federal standards for takedown requests related to intimate images, creating new liabilities and responsibilities for tech companies.

Critics and supporters alike agree on one point: as deepfake technology evolves, so too must the legal tools to combat its misuse. Whether the Take It Down Act strikes the right balance between protection and free expression remains a contentious debate.
