A US Department of Justice spokesperson confirmed the arrests were made "pursuant to extradition proceedings." The US and UK operate under a treaty permitting extradition for offenses punishable by at least one year in prison under both nations' laws — a legal bridge built specifically for cases like this one.

The process itself unfolds like a relay race: the CPS prepares a request certified by a judge, which then passes to the Home Office, which forwards it through diplomatic channels to the US State Department. Defense Attorney Calls Charges A "Political Hit"

Joseph McBride, a lawyer representing the Tates, said on X that the brothers are due in court "first thing" Monday US time. In a statement issued after their Saturday arrest, McBride didn't mince words: "the world knows Andrew and Tristan are innocent."

"Their enemies know it best of all. That is exactly why they have been attacked," McBride said, framing the fresh UK charges as a "political hit" designed to counter a defamation lawsuit the brothers had filed in the US.

He noted he had "not seen a satisfactory answer" explaining why the CPS is now pursuing US extradition after a Romanian court ruled in 2024 that the brothers could only be extradited from Romania once their case there wrapped up.
