TikTok to Pay $400 Million to Settle Justice Department Child Privacy Lawsuit

TikTok and its parent company, ByteDance, have agreed to pay $400 million to settle a U.S. Justice Department lawsuit alleging violations of federal children's privacy protections. 

The settlement resolves litigation filed in 2024 and represents one of the largest recoveries obtained under the Children's Online Privacy Protection Act, or COPPA, according to the Justice Department.

Under the agreement announced Aug. 21, TikTok will pay $300 million immediately and another $100 million after a previous consent decree involving Musical.ly is vacated. The Justice Department said the settlement also reflects significant changes the company has made to its ownership, management, compliance operations and privacy practices since the lawsuit was filed.

Justice Department Alleged Children's Privacy Violations on TikTok

The Justice Department's 2024 complaint alleged that TikTok and ByteDance allowed children younger than 13 to create accounts without parental knowledge or consent.

The government also alleged that TikTok collected personal information from children using the platform's “Kids Mode” and did not consistently comply with parents' requests to delete their children's accounts and personal information.

The lawsuit followed an earlier federal settlement involving Musical.ly, the predecessor platform that was acquired by ByteDance and eventually became part of TikTok. The 2024 complaint alleged that the companies violated COPPA and failed to comply with requirements established by the earlier agreement.

The Justice Department emphasized in announcing the new settlement that the claims resolved by the agreement were allegations and that there had been no determination of liability.

TikTok Privacy Protections Have Changed

The Justice Department said TikTok has made extensive changes since the government filed its complaint.

Those changes include measures intended to strengthen protections for younger users, improve age-related controls and expand parental oversight. The department said those developments contributed to its decision to resolve the litigation through a settlement.

The agreement comes as TikTok's U.S. business has undergone a significant restructuring. A new TikTok U.S. Data Security joint venture is majority-owned by U.S. investors and operates independently of ByteDance for purposes addressed by the federal government's restrictions on TikTok on government devices.

ByteDance retains an ownership interest in the restructured U.S. business.

ByteDance and TikTok Face Broader U.S. Scrutiny

The privacy settlement is separate from the broader national security controversy surrounding TikTok and ByteDance.

For years, U.S. officials have raised concerns about the relationship between TikTok's parent company and China, including questions about data security and access to TikTok's recommendation technology. Congress passed the No TikTok on Government Devices Act in 2022, restricting the application on federal government devices.

A July 2026 Justice Department opinion concluded that the restructured TikTok U.S. Data Security joint venture does not fall under that particular prohibition because it is majority-owned by U.S. investors, operates independently of ByteDance and has made changes to its recommendation algorithm and cybersecurity program.

The legal history also includes a 2025 Supreme Court case involving the federal law governing TikTok's ownership structure.

What the $400 Million Settlement Means

The settlement closes the Justice Department's child privacy litigation while placing a substantial financial obligation on TikTok and ByteDance.

The government described the $400 million recovery as one of the largest ever obtained in a COPPA case. The department also said the agreement allows the government to recognize privacy and compliance changes that have already been implemented rather than continuing a potentially lengthy court fight.

The case underscores the continuing legal obligations facing social media companies that collect information from children. Under COPPA, online services generally must provide notice to parents and obtain verifiable parental consent before knowingly collecting personal information from children under 13.

For TikTok, the settlement adds another major development to a complicated U.S. regulatory history involving children's privacy, data security, corporate ownership and national security.
