Two New Lawsuits Filed Against SpaceX by Former Employees Alleging Safety‐Related Retaliation and Wrongful Termination

Two former SpaceX employees have filed separate federal lawsuits alleging wrongful termination after raising safety concerns and seeking medical accommodations. The complaints paint a picture of a workplace culture where production schedules and cost-cutting allegedly take precedence over worker safety and proper medical care, with both plaintiffs claiming retaliation for speaking up about dangerous conditions.

LOS ANGELES, CA - SpaceX, Elon Musk's aerospace giant racing to revolutionize space travel, now faces serious legal challenges from within its own workforce as two former employees allege the company prioritized speed and profits over worker safety and basic employment protections.

The dual lawsuits, recently moved to federal court, present allegations about a corporate culture where employees who raise safety concerns or seek medical accommodations face swift retaliation. These cases emerge at a critical time as SpaceX accelerates its ambitious Starship program for NASA missions while maintaining its record-breaking Falcon 9 launch schedule.

Supervisor Sounds Safety Alarm, Loses Job

Robert Markert, a 13-year SpaceX veteran who worked as a supervisor, alleges in his complaint that he was terminated in April after repeatedly warning management about dangerous working conditions. According to the lawsuit, Markert specifically cautioned SpaceX leaders that one aspect of their rocket fairing recovery process could "easily cause serious injury or death."

The response he received, according to the complaint, was dismissive because the dangerous method "was the more economical solution." This alleged exchange encapsulates what Markert describes as a pattern of prioritizing cost savings over worker safety throughout his tenure at the company.

Markert's lawsuit details a punishing work environment where technicians were allegedly required to work 15 to 20 consecutive days. When he brought these concerns to supervisors, he was told "the schedule comes first," according to the complaint. The relentless pace, performed in what Markert describes as a high-stress environment, resulted in injuries that ship technicians were allegedly too afraid to report for fear of repercussions.

The supervisor's attempts to improve workplace safety through enhanced training and certifications were met with resistance. According to the complaint, management told him "there is no time for that and the company would not spend money on it."

Plumber's Medical Needs Met with Termination

The second lawsuit comes from David Lavalle, a 60-year-old plumber who joined SpaceX in 2014. Lavalle's complaint tells a different but equally concerning story about alleged discrimination and retaliation, this time involving workplace injuries and medical accommodations.

According to the lawsuit, Lavalle sustained multiple work-related injuries during his decade-long tenure, including a fractured foot, severe neck pain, back and shoulder injuries, and wrist pain. While he filed workers' compensation claims for some injuries, he allegedly refrained from filing for others due to fear of retaliation from the company.

The situation came to a head when Lavalle requested medical leave for gout-induced knee pain. Just nine days after making this request, he was terminated, according to the complaint. Lavalle alleges this termination was part of a broader pattern of age discrimination, claiming he was caught up in a wave of firings targeting older staff members.

Legal Proceedings Move to Federal Court

Both complaints were initially filed in Los Angeles County Superior Court but have since been removed by SpaceX to the U.S. District Court for the Central District of California. This move to federal court is typical in employment disputes involving large corporations and may indicate SpaceX's strategy for handling these cases.

🛑 It should be noted that the assertions in Markert's and Lavalle's lawsuits are merely allegations and have not been proven in a court of law.
