Challenging California's Climate Mandates

In a bold move on Tuesday, the U.S. Chamber of Commerce, alongside the American Farm Bureau Federation and four other prominent groups, launched a legal battle against California. Their target? California's recent implementation of corporate climate disclosure laws, a move they argue violates constitutional rights and oversteps state jurisdiction.

Constitutional Clash

The coalition of business heavyweights filed a lawsuit urging a California federal court to intervene and halt the enforcement of Senate Bills 253 and 261. These bills, signed into law by Governor Gavin Newsom, compel corporations to disclose detailed climate data. However, the plaintiffs contend that such mandates infringe upon the First Amendment, clash with federal law, and disrupt the balance of federalism.

Represented by Eugene Scalia, a legal titan and former Trump administration official, the plaintiffs are armed with a formidable legal team. At the heart of the dispute lies Senate Bill 253, dubbed the Climate Corporate Data Accountability Act. This legislation demands companies with over $1 billion in annual revenue to divulge the extent of their carbon footprint across various operational dimensions. Additionally, Senate Bill 261 requires corporations with revenues exceeding $500 million to furnish biennial reports detailing their climate-related financial risks.

Governor Newsom, upon signing the bills, acknowledged concerns regarding implementation deadlines and potential financial burdens on businesses. Yet, the plaintiffs argue that such laws coerce companies into expressing views they may not endorse, transcending commercial necessity.

The lawsuit also raises concerns about California's perceived ambition to regulate global conduct. While conceding California's jurisdiction over emissions within its borders, the plaintiffs vehemently oppose the state's foray into global emissions regulation, branding it a novel form of speech regulation.

Tom Quaadman, executive director of the U.S. Chamber's Center for Capital Markets Competitiveness, issued a stark warning about the repercussions of California's mandates. He cautioned that the laws could sow discord among states, burden businesses with compliance costs, and undercut America's capital market competitiveness.

As the legal skirmish unfolds, both sides brace for a protracted courtroom battle. While counsel for the plaintiffs remained tight-lipped, CARB refrained from commenting on the ongoing litigation.
