Insurance Impact at a Glance

  • CMS says it canceled 315,000 Affordable Care Act (aka ‘Obamacare’) policies covering roughly 760,000 people after eligibility and enrollment concerns were identified.
  • Federal officials are preparing additional immigration-status and income verification for approximately 415,000 Marketplace enrollees.
  • The crackdown extends to insurance distribution, with hundreds of brokers facing removal and new broker registrations temporarily frozen.

The Trump administration has launched one of its largest enforcement actions involving the Affordable Care Act Marketplace, with the Centers for Medicare & Medicaid Services saying it canceled 315,000 health plans covering approximately 760,000 people during August.

CMS cited unverified citizenship or immigration documentation along with suspected improper enrollments. That distinction is important. A canceled or questioned enrollment does not, standing alone, establish that every affected individual personally committed fraud. Some of the problems identified by federal officials involve unauthorized enrollment by insurance agents or brokers, duplicate coverage, questionable identity information or failures to substantiate eligibility.

Vice President JD Vance, whose White House anti-fraud task force has been directing the effort, publicly described the affected population in round numbers as roughly 750,000. Reporting based on the government's regulatory documents places the number closer to 760,000 individuals. Administration officials estimate the cancellations could prevent approximately $2.2 billion in federal spending.

There is also an important numerical clarification regarding the next phase of the review. Current reporting places the additional population undergoing immigration and income eligibility verification at approximately 415,000, rather than the 419,000 figure circulating in some accounts of the announcement.

Under the ACA, eligibility to enroll in a qualified health plan through an Exchange generally requires an individual to be a U.S. citizen or national or to be “lawfully present” in the United States. Eligibility for advance premium tax credits is also tied to statutory income and other requirements. CMS has increasingly tightened the verification procedures used to determine whether applicants qualify for federally subsidized coverage.

The administration's concerns are not based entirely on theoretical vulnerabilities. The Government Accountability Office reported in December 2025 that federal Marketplace fraud risks persisted. GAO investigators succeeded in obtaining subsidized coverage for fictitious applicants and identified tens of thousands of Social Security numbers associated with more than a year's worth of subsidized coverage during a single plan year. GAO separately identified more than $94 million in advance premium tax credits associated with households containing Social Security numbers that matched certain death-record scenarios.

But there is an equally important limitation. GAO expressly cautioned that its covert testing was illustrative and could not be generalized to the entire ACA enrollee population. Likewise, HHS estimates describing millions of “improper,” “phantom” or potentially fraudulent enrollments rely partly on administrative patterns and statistical analysis; those categories should not be confused with individually adjudicated findings of criminal fraud.

For the insurance industry, the enforcement action reaches beyond policy cancellations. CMS is moving to bar approximately 569 brokers after identifying what it characterized as statistically implausible application activity and has imposed a temporary freeze on new Marketplace broker registrations through February 1, 2027. The National Association of Benefits and Insurance Professionals has objected to the blanket moratorium, arguing that enforcement should focus more narrowly on bad actors rather than legitimate licensed professionals.

From an insurance-compliance standpoint, this is where the story becomes especially significant. Carriers, brokers and Marketplace administrators now face questions involving termination dates, premium-tax-credit reconciliation, consumer notification, identity verification and the possibility that legitimate policyholders may be caught in an eligibility review. CMS previously acknowledged widespread unauthorized enrollment and plan switching and has procedures for consumers to challenge or correct improper Marketplace activity.

The action does not repeal Obamacare. It is an administrative program-integrity and eligibility-enforcement action operating within the existing ACA framework.
