As I pen this, I find myself contemplating a question I wish I didn’t have to ask: what might a global war mean for the legal and insurance sectors? With Russia warning that any further U.S.-backed Ukrainian attacks would draw "adequate and tangible" Russian retaliation, the world stands on the precipice of serious geopolitical unrest. Russian spokesperson Maria Zakharova underscored the gravity of the situation, stating that long-range missile use could signify direct Western involvement in a full-scale war. And if conflict intensifies, the ripple effects will surely reach insurance providers, legal institutions, and judiciary bodies globally.

Insurance Sector: Policies Tested by War

Insurers often craft policies with "war exclusions," clauses that relieve them of liability for damages caused by acts of war. However, the fine print in many of these contracts could lead to contentious debates if full-scale hostilities affect civilian sectors. For instance, property insurance policies—whether covering infrastructure in conflict regions or commercial assets abroad—could see unprecedented claims. If missiles stray into NATO territory, even basic property and casualty insurers might have to grapple with claims that invoke war or terrorism exemptions, leaving policyholders at risk of uncovered losses.

For life and health insurers, policies often have similar exclusions for acts of war. What’s more, potential military draft scenarios could impact insured groups, especially if personnel suffer injuries or fatalities. Businesses could see higher premiums for areas considered high-risk due to proximity to conflict zones, affecting everything from property insurance to life and disability coverage. The insurance industry will need to prepare for the legal disputes likely to emerge as clients challenge denials based on war exclusions.

Legal Landscape: A Surge in War-Time Legislation

Wars don’t just impact the battlefield; they often catalyze swift legislative changes that impact all facets of society. Courts could find themselves interpreting a surge of new wartime laws, especially as states strengthen domestic security measures and redefine public rights and limitations. Legal rights that were once taken for granted could shift, as governments work to balance national security with civil liberties. This tension could lead to numerous lawsuits, as individuals and organizations challenge the scope of war-time authority.

A world conflict could also mean cross-border litigation involving claims of human rights violations, international sanctions, and war crimes. Notably, leaders like Vyacheslav Volodin have hinted at the potential for Russia to deploy advanced weapons not yet used in Ukraine. If these weapons cause mass casualties, international legal bodies like the International Criminal Court (ICC) could become venues for addressing such actions. However, major players such as the U.S., Russia, and China have historically limited ICC jurisdiction, which could complicate accountability and legal redress.

Judiciary Sector: The Keeper of Wartime Accountability

The judiciary would play a crucial role in ensuring accountability and upholding international law. Courts might oversee cases related to sanctions, war crimes, and violations of international human rights. Domestically, judges could be called upon to decide cases involving state authority, citizen protections, and even war-related property seizures. In the U.S., for instance, we could see a heightened role for the judiciary in interpreting acts under the War Powers Resolution or evaluating the limits of executive action during times of international conflict.

The judiciary’s role also extends to economic sanctions imposed by Western countries against Russian assets and businesses. With sanctions mounting, Russian entities may turn to international courts to dispute them, creating high-stakes cases that hinge on complex global regulations. The judiciary’s decisions in these cases would not only influence policy but also set precedents for future conflicts.

Russia’s Position and the Uncertainty Ahead

If tensions between Russia and the West reach a boiling point, international legal bodies could serve as platforms for both sides to argue claims of self-defense versus aggression. But the effectiveness of such venues in achieving peaceful resolutions will depend heavily on cooperation, diplomacy, and respect for international law—principles that war tends to erode.

Our legal and insurance sectors will bear a brunt of wartime crises, balancing between state demands and the rights of individuals. The judiciary, meanwhile, stands as our last line of defense in interpreting laws that could safeguard—or restrict—our liberties in unprecedented ways.
