Elon Musk's artificial intelligence venture is not backing down. Fresh off a courtroom defeat in Minnesota, xAI has escalated its First Amendment battle to the appellate level, asking the St. Louis-based 8th U.S. Circuit Court of Appeals to freeze enforcement of a state law that restricts AI tools capable of generating fake nude images of real people.

The filing, submitted under the case caption X.AI LLC v. Keith Ellison, seeks what's known as an injunction pending appeal — a legal maneuver that would pause the law's enforcement against xAI while the broader constitutional fight winds through the courts. It's a familiar posture for companies that have lost at the trial level but aren't ready to concede the underlying legal question, and it signals xAI intends to press the issue as far as it can go.

How We Got Here

The dispute traces back to Minnesota's enactment of HF 1606, a law state lawmakers built to confront what they describe as a rapidly metastasizing problem: AI software that can convincingly strip clothing from photographs of identifiable people, creating nonconsensual sexual imagery indistinguishable from the real thing. The statute bars website operators, software developers and other platforms from letting users generate that kind of content, and it exempts services that would require genuine technical sophistication to misuse. Violators face civil penalties reaching $500,000 per incident, along with the possibility of injunctions and other court-ordered remedies. Individuals depicted in the altered images can also sue directly, and in some circumstances, so can the platforms that hosted the content.

The law took effect August 1. xAI, which develops the Grok Imagine tool, sued Minnesota Attorney General Keith Ellison beforehand, arguing the statute unconstitutionally restricts protected expressive activity and effectively holds AI developers liable for outputs they say they cannot fully control or predict.

A Judge Unpersuaded — Twice

U.S. District Judge Donovan Frank wasn't swayed. In a ruling handed down September 4, Frank declined to issue a preliminary injunction, marking the second time he'd rejected xAI's bid to pause the law — the first coming when he allowed the statute to take effect as scheduled despite the pending litigation.

Frank's reasoning centered less on the merits of xAI's free-speech argument and more on timing and evidence. The company, he noted, waited nearly three months after Minnesota's governor signed the bill into law before filing suit, and didn't do so until just three days before the statute took effect. For a company with xAI's resources, that delay undercut its claim of urgent, irreparable harm.

"xAI is a sophisticated and well-resourced litigant with the means to move quickly when its interests are at stake,"Frank wrote. "If xAI genuinely feared irreparable harm, the court does not doubt it would have acted more quickly to file this action."

The judge also found that the balance of equities tipped decisively toward the state, given the legislature's stated goal of curbing a technology capable of significant harm to real people — including, advocates note, minors. Still, Frank didn't dismiss xAI's constitutional argument outright. He acknowledged the underlying legal questions are genuinely difficult and said they would receive full consideration as the case proceeds. "The constitutional issues raised by the parties are complex, particularly when considered in the context of this new technology and the risks that it poses to the public," he wrote.

With the district court unwilling to hit pause, xAI's only path to blocking enforcement in the near term runs through the appellate court. The 8th Circuit will now have to weigh whether xAI has shown enough likelihood of success on its First Amendment claim — and a strong enough case of imminent harm — to justify freezing a law state officials argue exists to protect victims of a fast-growing form of digital abuse.

For now, Minnesota's ban remains in force, and Attorney General Ellison's office retains its enforcement authority while the appeal is pending. The case is being closely watched well beyond Minnesota's borders, as it's likely to become an early test case for how courts nationally will balance First Amendment protections for AI-generated content against state efforts to curb nonconsensual intimate imagery — an issue several other legislatures are actively considering as similar bills move through statehouses across the country.
