9th Circuit Renders Ruling: Meta, Google, TikTok and Snap Must Face 3,000+ Youth Addiction Lawsuits — And the Timing Couldn’t Be More Damning

A federal appeals court just told Silicon Valley's biggest platforms: not so fast.

On Monday, the 9th U.S. Circuit Court of Appeals in San Francisco rejected an attempt by Meta and TikTok to short-circuit more than 3,000 lawsuits accusing them, alongside Google and Snap, of deliberately engineering their products to hook young users. The companies wanted out early, arguing Section 230 of the Communications Decency Act — the law that generally shields platforms from liability over what users post — should also protect them from claims that they designed addictive products and failed to warn the public about it.

The court wasn't buying the timing. Section 230, the judges held, offers a defense a company can raise at trial — it isn't a jurisdictional immunity that lets a defendant walk away from a case before it's finished. Most appeals happen after a verdict, not before. Meta and TikTok wanted an exception. They didn't get one.

The practical effect is enormous. The consolidated federal litigation, overseen by U.S. District Judge Yvonne Gonzalez Rogers in Oakland, includes suits from states, school districts, municipalities and individual families. Add in the roughly 3,300 related cases moving through a parallel proceeding in California state court, and the platforms are staring down what may be the largest coordinated product-liability campaign the tech industry has ever faced.

Meta's second loss of the day came just as fast. The company also asked the court to freeze a trial set to begin Wednesday, brought by 29 state attorneys general who allege Meta illegally harvested children's data, engineered its platforms for compulsive use, and misled the public about the risks. The court said no — the trial goes forward as scheduled.

Attorneys Lexi Hazam and Previn Warren, who represent thousands of school districts and individuals in the federal litigation, framed the ruling as a win for transparency. A trial, they said, is how the public finally learns what these companies knew about the harm their products caused, when they knew it, and what they did with that knowledge — evidence they argue Meta has fought hard to keep out of view. A second trial, covering school-district claims, is scheduled for February.

The backdrop makes the ruling land even harder. Just days earlier, a New Mexico judge found that Meta had created a public nuisance in the state, ordering the company to pay $567 million into a teen mental health fund and to adopt new youth-safety measures — following an earlier phase in that same case where a jury ordered Meta to pay $375 million for misleading consumers about platform safety. And in March, a Los Angeles jury delivered the first verdict in the parallel California state litigation, finding Meta and Google negligent in a case brought by a young woman who says she became addicted to Instagram and YouTube as a child, awarding her $6 million. Both Meta and Google have denied wrongdoing and say they'll appeal.

Platform accountability isn't just a courtroom story. It's playing out in real time, in how these companies moderate what happens on their platforms right now. TikTok itself acknowledged this week that a moderator error delayed the removal of a livestream showing celebrity blogger, Perez Hilton in visible crisis, and engaging in acts of self-harm on camera before the platform intervened and the account was banned. Whatever the individual circumstances, the incident reignited the same question at the heart of the federal litigation: when platforms build systems engineered to maximize attention and reach, how quickly — and how well — do they respond when something goes wrong in front of a massive, young audience? Monday's ruling means that question, and thousands like it, will now be tested in open court rather than dismissed at the courthouse door.
