Pfizer $50m Epipen Settlement

In a turn of events that resonates like a modern-day David vs. Goliath story, Pfizer Inc., the pharmaceutical giant, has consented to pay a whopping $50 million. This move seeks to conclude claims suggesting that both Pfizer and Mylan Pharmaceuticals manipulated emergency allergy medication prices, a tale entangled in years of court battles and extended deliberation periods. This decisive action emerged from a motion filed in the heartland state's federal court - Kansas.

Pfizer $50m Epipen Settlement : A Victory for the Buyers?

Labeling Pfizer's settlement as an "outstanding outcome," EpiPen consumers, who were previously grappling with the district court's dismissal of their grievances, expressed their relief and optimism. They fervently argued, "Had there been no merit in our claims against Pfizer, we wouldn't have passionately pursued them." Yet, the impending threat of prolonged court wrangling was never far from their minds.

Casting a wider net, they implored the court to recognize a nationwide settlement class, encompassing every individual or entity that bought EpiPens or their generic counterparts from Mylan or Teva, targeting resales from March 2014 till the dispute's resolution. This vast network consists of 74 members, spread as wide as the American landscape.

It's worth noting that Teva Pharmaceuticals remains an outsider in this altercation.

Pfizer $50m Epipen Settlement : The Origin of the Controversy

Journeying back to February 2020, KPH Healthcare Services threw the gauntlet at Mylan and Pfizer, alleging a sinister plot: a bid to monopolize the market for the lifesaving epinephrine auto-injector devices and thwarting generic competition. They further lambasted the two for compelling EpiPen customers to dig deeper into their pockets.

Yet, the plot thickened in August 2022. U.S. District Court Judge Daniel Crabtree discarded all of KPH's allegations against Pfizer. His justification? KPH wasn't in Pfizer's direct sales lane, therefore lacking the legal grounds for their accusations, especially considering the precedent set by the Supreme Court's ruling in Illinois Brick Co. v. Illinois.

Nonetheless, the Tenth Circuit identified a potential legal crevice in January, suggesting that the Illinois Brick decision might not necessarily barricade KPH's claims. Mylan remains entrenched in this legal tug-of-war.

Arguing their standpoint, KPH pointed to the vast geographical spread of its members, with many being small-scale wholesalers lacking the financial might for protracted legal battles. They emphasized the common thread of injury sustained by all plaintiffs: excessive payments due to the alleged anticompetitive behaviors of the defendants.

Legal Representatives and Counsel

KPH pressed for Michael L. Roberts (Roberts Law Firm PC) and Linda P. Nussbaum (Nussbaum Law Group PC) to steer the settlement class and Bradley T. Wilders (Stueve Siegel Hanson LLP) to act as the liaison counsel. The motion revealed KPH's intention to carve out attorney fees amounting to 33% from the settlement treasure chest.

As the curtains drew on Tuesday, representatives from Pfizer and the plaintiffs remained tight-lipped, with no comments forthcoming.

The Legal Brigade

For the record, KPH's legal cavalry consists of Linda P. Nussbaum, Michael L. Roberts, Erich P. Schork, Sarah E. DeLoach, Norman E. Siegel, Bradley T. Wilders, and Jordan A. Kane. On the other end, Pfizer’s legal defense is marshaled by Raj Gandesha, Edward Thrasher, Kathryn Swisher, Joseph Rebein, and Ashley Harrison.
